Vacancies for the RS Constitutional Court and for the RS Component for the BiH Constitutional Court Re-announced

Due to a lack of enough appropriate candidates to fill the “vital interest panel” for the Republika Srpska Constitutional Court (Article 116 of the Republika Srpska Constitution) the High Judicial and Prosecutorial Council of Republika Srpska has decided to reissue the vacancy announcement for that Court.

The High Judicial and Prosecutorial Council of Republika Srpska has also decided more applications were needed in order to finish the selection of members to the Republika Srpska component of the Constitutional Court of BiH; therefore the RSHJPC is re-announcing these two vacancies as well.

The judges both to the Republika Srpska Constitutional Court and the RS Component of the Constitutional Court of BiH are to be selected by the National Assembly of Republika Srpska.

The vacancies for the Republika Srpska Constitutional Court were originally announced in August this year. The Council found, however, there were not enough candidates who had declared themselves as other than “Serb” and that it was not possible to propose candidates to fill the “vital interest panel” of this Court, which exists pursuant to Article 116 of the Republika Srpska Constitution.

In order to be eligible for the Constitutional Court of Republika Srpska, an individual must fulfill the following basic requirements set forth in the law on the High Judicial and Prosecutorial Council of Republika Srpska:

·        be a citizen of Bosnia and Herzegovina;

·        be a graduate from a law school in Bosnia and Herzegovina or in the Socialist Federal Republic of Yugoslavia or from another law school provided that the diploma issued from that school has been validated in accordance with the law;

·        shall have passed a bar examination administered in Bosnia and Herzegovina, in the Socialist Federal Republic of Yugoslavia or, in respect of currently serving judges and prosecutors, in another country whose territory was part of the territory of the Socialist Federal Republic of Yugoslavia.

In addition to the basic requirements, an individual must fulfill specific practical experience requirements set forth in the Law.

In September this year, after the High Representative had annulled the selection of two judges to the RS Component of the Constitutional Court of BiH, the RS HJPC announced these posts vacant. When processing the received applications, the Council found the number of applicants too small to allow the Council to make a proposal to the RS National Assembly.

To be eligible for the announced posts for the Republika Srpska component in the Constitutional Court of BiH, an individual must fulfil the following basic requirements:

·        eligible voters of Bosnia and Herzegovina and

·        distinguished jurists of high moral standing.  

The deadline for submission of applications is January 13, 2003.
