L. – The BiH Constitutional Court decided that the names of the Municipalities and towns in the RS which had prefix ‘Serb’ will not be used any longer and at the same time passed the decision on temporary names of these Municipalities and towns until the RS National Assembly and RS Council of Peoples pass the finale decision on this issue.The Court brought decision on temporary names concluding that the RS National Assembly did not act in timely manner to ensure implementation of the Court’s previous instruction.

BHT 1 Fri – “I will remind that decision of the Constitutional Court are final and mandatory and that they have to be respected, regardless does someone like them or not,” Mato Tadic, Chairman of BiH CC, stated. 

RTRS Fri “It is not up to the Constitutional Court to worry about procedures that should be carried out by National Assembly. [They] knew that they to start with the procedure and not wait for the last moment”, says Tadic.

BHT 1 Fri, FTV Fri – “We will use all constitutional possibilities to prevent these illogical decisions, because this decision truly has no sense; it is rushed, it was made under the pressure and it is clear political decision and not the decision of highest Court Institution as the Constitutional Court is. And the thing I find shocking is the stance of RS representatives in CC, what they have been doing there, how they can accept these kinds of stances. Simply, I think that this decision of the Court is political and it will get a political response”- said Cavic.

L. – RS Prime Minister Dragan Mikerevic has assessed this decision as a precedent by which the Constitutional Court was transformed into a legislative body. He emphasised that the Government’s lawyers will consider this decision to find out whether it is in accordance with the Law on the Constitutional Court .

FTV Fri, BHT 1 Fri – “We… have to accept that and make it happen, but I have to say that this truly, I believe, presents one precedent; it seems to me that CC is turning into the legislative body” said Mikerevic. 

Reactions by RSNA Speaker and Deputy Speaker

 

FTV Fri – Commenting to the aforementioned decision of the BiH Constitutional Court, the Speaker of the RS National Assembly, Dusan Stojicic, said: “We’ll see, when we get this decision, we will evaluate what it truly means and what kind of possibilities there are for us in RSNA… We were accused of not implementing the decision of the Constitutional Court, that is very serious accusation, I believe that we will have to make certain moves.”   

RTRS Fri “I think these decisions violate the laws that are guaranteed under the European Charter on local self-governance. The laws clearly state that citizens living in the area have the right to decide on this matter” says Dusan Stojicic.

BHT 1 Fri – “I think that this is a clear signal to the institutions of the Government that they have to assure that all issues are acceptable to everyone”- said Sefket Hafizovic, RSNA Deputy Speaker.

Halilovic says citizens of cities in question have to change documents

 

BHT 1 by Marina Boskovic – BiH Civil Affairs Minister, Safet Halilovic,said that citizens of municipalities with new names in RS will have to change personal documents in accordance to the decision of BIH Constitutional Court . According to Halilovic, costs of document change should be covered by RS institutions that failed to implement the Court’s decision in timely manner.

Serb Caucus in RS CoP demand resignation of Remzija Kadric  

 

Glas Srpske, Saturday, cover page ‘Kadric, resign!’ by G. D., EuroBlic, Saturday, pg. RS3 ‘Caucus of Serb delegates requested for Kadric’s resignation’ by R. R.Serb caucus at RS Council of Peoples on Friday asked from CoP Chairman Remzija Kadric to resign over abuse of office. The caucus claims he was obliged to convene a session of CoP within a deadline in which the council was obliged to decide on the Law on Changes and Addenda to the Law on Territorial Organisation and Local Self-government [which address the issue of prefix ‘srpski’ in names of some RS cities and municipalities], but that Kadric had failed to do so.

RTRS Fri – Kadric on the other hand accuses RS Government for the delay. He claims that the Government didn’t prepare the law on time and therefore the deadline given by the Constitutional Court was not met. “National Assembly adopted the law on 27th July and the deadline given by Constitutional Court was 11th of August…Council of People didn’t have enough time to declare itself on that matter”, says Kadric.

Tulic – Trial in case of Ante Jelavic, Miroslav Prce, Miroslav Rupcic, friar Ivan Sevo and Ivica Karlovic, accused of embezzlement in “Hercegovacka Banka” case,commenced on Friday at BiH Court. According to dailies, after only 20 minutes of considering the Panel of Judges rejected all objections on the court procedure submitted by the defence (the lawyers disputed legitimacy of the Panel of Judges and competence of the BiH Court in this process and demanded that the BiH Constitutional Court passes the final decision on this issue). Defendants and their lawyers also disputed the fact that two foreigners are members of the Panel of Judges since according to their opinion the Panel of Judges should be made of domestic judges exclusively. During the trial Jelavic stated: “I cannot accept that foreign citizens are in charge of the court process in my country and I cannot accept that any other language apart from the language of my people is used during the court process…” Jelavic also said that he was fighting for reshaping of the Dayton Peace Accord without the use of force so that his people become equal with other two peoples and added: “I was fighting for the things that every normal and sane person stands for now including the High Representative.” The dailies also carry that Jelavic’s lawyer Josip Muselimovic stated that the lawyers wonder whether it makes any sense to participate in such court procedure. He added that he and lawyers Senka Nozica and Nikola Grljic (who are also engaged in this case) will meet on Monday and pass the final decision whether they will continue to work in this case or not.

Relota – Reacting to the trial against Ante Jelavic and other suspects in the Hercegovacka Banka case, HDZ BiH issued a press release which says that this trail is a rigged process out of all legal and constitutional frameworks of BiH. “We believe that the single sin of Ante Jelavic is that he, before everybody else, recognized the need for BiH to be constitutionally reorganized and for its structure to be acceptable to all three constituent peoples and all citizens of BiH,” press release reads. HDZ demands for a “farce to be ended, and those responsible for illegal arrest and detention of Ante Jelavic to be legally processed and sanctioned for their actions.

Tadic denies allegations that BiH CC judges are corrupted

B., Vecernji List Sat pg 2 ‘Judges: We were not receiving bribe’ by eme – President of the BiH Constitutional Court Mato Tadic resolutely denied the claims about alleged corruption of the judges working in this Court. He qualified as absurd the claims according to which the judges from this Court were receiving bribe in order to obstruct passing of the decision in the cases dealing with immunity.

FTV Fri – I resolutely deny the information, broadcast by FTV [Thursday] night,” said Tadic.  FTV broadcast on Thursday claimed that investigative bodies in BiH have been carrying out the investigation due to suspicion that some judges have accepted bribery and that they are postponing the discussion on the Law on Immunity. Regarding the decision on the Immunity Law, Tadic said that the case is closed, apart from the technical part to verify the text. FTV says that this means that final decision can be expected at the next session, which is scheduled for next month, adding that such delay goes in favour of some former and current high ranking politicians.

Hays warns MIP BiH on visa misuses

 

Oslobodjenje Sat cover splash, pgs 4-5 ‘Foreign Affairs Ministry hides data on passports and visas’ by Azhar Kalamujic – In a letter last week to BiH Foreign Minister Mladen Ivanic, Principal Deputy High Representative, Donald Hays, warned that the abuses and lapses in issuing visas to foreigners in diplomatic network of BiH presents a treat to the international security and continue to damage BiH reputation in the global fight against terrorism. Hays sent a letter following the media reports on 60 visas missing from BiH’s Consulate in Brussels , and other possible cases in Embassies in Aman, Peking and New Delhi . Hays warned Ivanic actions were carried out to correct the lapses. Ivanic was also warned that Foreign Affairs Ministry has not submitted the information to the BiH Security Ministry on visas issued to foreign citizens, adding that the Ministry has a legal obligation to submit such information to the State Border Service, SIPA and other law enforcement agencies in BiH. Daily carries that OHR’s most difficult accusation says that Foreign Affairs Ministry allegedly rejected to participate, together with CIPS, in establishment of unified electronic database of issued visas. Finally, Hays asked Ivanic to answer within 15 days on made changes. Inset ‘Hays’ pet’ – According to unofficial information from Foreign Affairs Ministry, the majority of Hays’ objections with regard to unification of information on passports and visas are not a fault of the Ministry but unstructured CIPS Directorate, referred to as ‘Hays’ pet’. Daily’s source says that for this reason Hays sent a letter to the Ministry, not CIPS.

MIP BiH confirms disappearance of visas

 

RTRS Fri, Dnevni List Sat pg 7 ‘All competent and state bodies were informed about disappearance of visas’ by A. Beus, Slobodna Dalmacija Sat pg 18 ‘Visa stickers disappeared from Embassy’ by B. Kristo – Spokesperson of the BiH Ministry of Foreign Affairs Lepa Babic stated that 60 stickers for visas disappeared from the BiH Embassy in Brussels and after the disciplinary procedure is over it will be known how they disappeared. Babic also denied speculations according to which employees in this Embassy were not familiar with the disappearance of the visas and she stressed that they were familiar with this problem and on the ground of this information the disciplinary procedure against some persons was launched.

K. – Babic stated for daily that Ministry’s representatives, OHR and EUPM met on Saturday to discuss protection measures with regard to the visa misuses. Commenting to PDHR’s letter to Mladen Ivanic, Babic stated that the Ministry is very keen to prevent cases of visa misuses to occur.

He stressed that “BiH authorities were strengthening everyday and that there was no need to stress that authorities were capable of fighting the crime.

RS authorities to pay 36 million KM of war damage compensation

Kolak – As according to the decision of Trebinje Regional Court, RS will have to pay approximately 8,2 million KM to brothers Salih and Muamer Alijagic, the owners of “Alijagic” firm, in the following 30 days to compensate damage caused to them. In 1993, then Ministry of Trades, Municipality of Trebinje and “Metalac” firm have confiscated property of “Alijagic” firm. The property was subsequently sold to buyers from Montenegro.

BHT 1 by Laura Bosnjak – The Peace Implementation Council Steering Board, meeting in Sarajevo on 23 and 24 September, praised the pace of law adoption and economic reforms leading BiH towards Brussels. That, however, is not enough as the start of negotiations with the European Union depends on the implementation of these laws, the High Representative Paddy Ashdown said for BHT 1. He said that some delegates voted for the reform laws while at the same time being convinced that the laws would not be implemented in practice. PIC has said that our country would miss the second chance to join the Partnership for Peace and negotiations with the European Union if 24 war crime indictees, including Radovan Karadzic and Ratko Mladic, are not arrested in the next three months. “If the citizens of BiH are again to be led by a small, corrupt group that deems it more important to protect war criminals than provide a future for the citizens in this country, I will most certainly react and take measures,” said HR Ashdown. According to reporter, the international community believes the RS authorities are obstructing conditions set by Brussels as a result of the belief that the future of that entity should be dictated by Belgrade. “There is a message for the Serb Republic authorities: Banja Luka has to understand that, if they want to step on the tracks leading to Europe, those tracks start in Sarajevo, not in Belgrade,” Ashdown stressed. PIC has warned that BiH Parliament must urgently pass the Law on PBS and implement all other laws, otherwise BiH will not get positive avis regarding the beginning of the negotiations on the Stabilization and Accession agreement. “We will certainly start with the negotiations at the beginning of the next year. Whether that will be in February or March, that isn’t so important at this moment, what is more important is to dedicate to the implementation of changed in BiH legislation, that must be felt on the field” said Adnan Terzic, Chairman of the Council of Ministers.

Talking about the Dayton Peace Accord (DPA), Mesic stated that the DPA stopped the war, however, it has not completely established mechanisms for functioning of BiH. Mesic concluded that finishing touches should be put on the DPA. Talking about the same issue, Tihic said that the political system established by the DPA is becoming an obstacle and the time for the beginning of the Brussels ’ BiH has come.   

BHT 1 Sat – Tihic said that the Dayton system could end next year, at its 10th anniversary, and after Mladic and Karadzic are arrested. According to Tihic, this could be an end of Dayton BIH, and beginning of Brussels BIH.

RTRS Sat –Tihic stressed that the main problem in inter-state relations is unsuitable behaviour towards war criminals.“Still in some countries and with some politicians there is a conscience of trying to justify war crimes and war criminals. It is justified and trying to be justified with protection of national interests or with the fact that others committed crimes too”, says Tihic

DL editorial on constitutional changes

 

Dnevni List Saturday pg 30 ‘BiH’s secret’ by P. Gasparevic carries an editorial on possible constitutional changes in BiH. Among the other things, the author says: “Actually, coming constitutional changes might give an answer to the question whether the Dayton Peace Accord was means to stop the war in BiH or a long-term projection of political and territorial arrangements. BiH is at the same time both the fact and secret.”

Cavic said that on this occasion Tihic was stating incorrect judgments about the situation in BiH, demanded a new constitutional organization of BiH and expressed policy of one BiH people only. Malagic – Chairman of the BiH Presidency, Sulejman Tihic, in a statement to DA said that he visited Muhamed Sacirbegovic [charged with embezzlement] while in visit to New York privately, adding that a lot of people appreciate what Sacirbegovic did for BiH during the war. “I am not ashamed of such people. I am not ashamed of people who defended BiH,” Tihic stated.

Kukan – In his address to opening of the main mosque in Sokolovic-kolonija, mufti Mustafa Ceric reminded of Belgrade’s magazine Duga, which often contain articles in favour of the Great Serbia and against Bosniaks. Ceric further said that “Duga”-alike people are now in BiH, referring to “those” criticising Tihic’s meetings with Sacirbegovic, adding: “They should know that there is no person who will forbid us to meet in New York, Brussels, Sarajevo, Zagreb, Belgrade. We are free people, we are free Muslims.”

EU emphasised the importance of functioning of SIPA, cooperation with the Hague Tribunal, implementation of obligations in relation to IPTF decisions on de-certifying of police officers, etc.

Glas Srpske, Saturday, pg. 2 ‘In front of the door of Europenot signed – BiH Minister of Foreign Affairs Mladen Ivanic has stated that during talks with EU representatives he ‘got a clear signal that BiH is on a good path to the admission to Euro-Atlantic integrations’. ‘This is an important day for BiH because this is the first time we have had a direct dialogue with the highest representatives of EU during which it was confirmed to us that we are at the doorstep of the admission to Europe’, Ivanic has stated.

German politician: BiH soon will not need HR

In an interview to Austrian media, Schoebl has said that a general deadline for the cease of the institution of high representative will be determined by a successful admission to the Association and Stabilisation Agreement, as well as the admission to the PfP. 

VL on restructuring of Mostar City Administration

Vecernji List Sunday pg 2 ‘Paddy Ashdown is coming to Mostar on Tuesday?’ by M. Relota – With regard to restructuring of the Mostar City Administration, VL carries that the Commission in charge of applications submitted for leading positions in the Mostar CA was supposed to publish the names of candidates who scored the bigger number of points on September 25, however, according to VL sources close to the OHR the publishing of these names has been postponed for October 1, 2004. VL says that they also received the information that High Representative Paddy Ashdown should visit Mostar on Tuesday September 28 in order to get familiar with the current course of a new Mostar Statute implementation. The article also says it is well known that there are difficulties when the agreement between the Croat and Bosniak sides regarding distribution of crucial positions in the Mostar CA is in question and according to VL the possibility that the OHR intervenes in case that the two sides do not reach the agreement is not excluded.

BiH Constitutional Court decides military apartments will not returned to JNA officers

Omeragic, – In considering the request submitted by delegate in BiH House of Representatives, Nikola Spiric, for assessing the constitutionality of Article 3a of the Law on terminating implementation of the law on abandoned apartments in Federation BiH, the Constitutional Court has fortified that the disputed decree is not contrary to the BiH Constitution. According to this decision, apartments declared abandoned during the war would not be returned to former JNA officers who remained in military service outside BiH after 19 May 1992 . Instead, these apartments will stay at the disposal of the FBiH Defence Ministry.

Nezavisne Novine, Saturday, Revija inset, cover and pgs 4-5 ‘Pre-election time is bad for a discussion on VAT’ by Mirza Cubro – In a two-page long interview to NN, CoM Chairman Adnan Terzic has stated he thinks that the BiH Parliament has commenced the discussion on VAT in a wrong period of time. He claims that the pre-election period is not good time to have discussions on extremely important system law. Apart from this, Terzic expressed his satisfaction with results of the international conference on development, which was held last week. Asked about negotiations with IMF on the stand-by arrangement, Terzic said: ‘I expect IMF would come to a final round of negotiations in mid October. As until now, we have mainly communicated through correspondence and we have tried to ensure better conditions for us. We have succeeded to have OHR and EC engaged in negotiations on a new stand-by arrangement. This is very important because, with support of these two institutions, we might persuade IMF to realize the current proposal is not good for BiH.’

Moskaljov – The dailies carry that Chairman of the BiH Presidency Sulejman Tihic is attending a regional conference of the Igman Initiative called ‘Future of Southeast Europe – BiH, Croatia, Serbia and Montenegro and perspective of European integration’, which started in Zagreb yesterday. Asked to comment on the statement of Vrhbosna Archbishop Cardinal Vinko Puljic who said that the position of Croats in BiH is dramatic, Tihic stated that the political parties, which were representing Croats in BiH, are responsible for this situation since they were promoting some sort of moving to various areas. Tihic added that the Catholic Church is also responsible since the Catholic Church should have said that such policy does not serve the interest of the Croat people. On the same issue Croatian President Stjepan Mesic said that ‘those who are criticizing now should say the whole truth – all sides are responsible, but we must not forget our responsibility either’.

Kresic – Commenting on the UNHCR report on return of refugees to BiH, Chairman of the European Parliament delegation for Southeast Europe Doris Pack called on the International Community to intensify pressure exerted against the RS in order to make possible return of Croats who were expelled from the RS territory by the Serb authorities. She also said that Croats who return to the RS are faced with much bigger problems than Serbs who return to the Federation of BiH.

Nezavisne Novine, Saturday, pg. 3 ‘They are still searching for documents of RS Army Headquarters’ by D. R. – RS Defence Minister Milovan Stankovic stated on Friday that RS institutions were still searching for wartime documentation of RS Army Headquarters. ‘Our commissions are browsing through archives and everything that will be found will be forwarded to the RS Government Secretariat for Relations with the Hague Tribunal, which will forward the material to the Hague Tribunal’, Stankovic stated. RS President Dragan Cavic assessed that all competent Ministries and the Government are working on these issues.

Oslobodjenje pg ‘It is still unknown where is documentation’ by Onasa – RS Prime Minister Dragan Mikerevic stressed that the Government doesn’t have reserves to fulfilling its obligation towards ICTY. “This is not about wanting, willing or wishing, but about possibility to do something,” said Mikerevic.

DA on meeting of Covic and Matijasevic over cooperation with ICTY

 

Dnevni Avaz Sat pg 4 ‘Ashdown’s ultimatum to Cavic and Matijasevic’ by S. Numanovic – DA writes that after the election, RS authorities will be more pro-actively engaged in arrest of war criminals and other obligations of RS needs to implement towards the ICTY. Daily says that Paddy Ashdown reiterated this to Dragan Cavic and newly appointed RS Interior Minister, Darko Matijasevic, when meeting them in Sarajevo on Thursday. DA learns that Ashdown strongly repeated this, adding that otherwise RS will face harsh sanctions. In addition, DA learns that three war crimes indictees hiding in the territory of RS announced they will surrender in exchange to benefits.

Dnevni Avaz Sun pg 5 ‘It is not up to me to arrest ICTY fugitives’, mentioned on cover, by Mira Zgonjanin – In an interview to DA, RS Prime Minister Dragan Mikerevic stated RS “must return the image, much better than the one we had. That is priceless. If RS was to be respected in the international relations and within BiH, it has to do what is expected to do. I am sure that anybody thinking differently in this situation works against this Republic.” He added that it is not up to RS Government, but authorized police structures to arrest war crimes suspects.
