Humphreys on PIC session tomorrow

 

BH Radio 1 – Head of the EC Delegation to BiH Michael Humphreys said in a statement for BH Radio 1 ahead of tomorrow’s Peace Implementation Council session in Brussels that a month and a half long crisis of government in BiH had slowed down the process of reforms in the country. The majority of the Feasibility Study requirements have been fulfilled but there is more work to be done by local authorities in the coming period, according to Humhreys.

He added that there are signs that cooperation has started, such as the transfer of Savo Todovic, but stressed that it also needs to be completed. “The process cannot be ended before all indictees, including Karadzic and Mladic, end up in the Hague. Nothing else will be enough”, Ashdown said, adding he hopes RS will recognize obligation to continue with cooperation with the ICTY. Del Ponte concluded that her office raised 6 indictments at the end of last year against 10 suspects.

PINK – Carla del Ponte said: “I think that it is a disgrace because of victims expecting justice to be satisfied. I am calling not only on the International Community here, but also on this nation to do everything in their power to locate not only Karadzic and Mladic but other war criminals as well.”

FTV – The topic of the meeting was not disclosed. “I will only [say] that we had informative talk of strategic nature. Those talks are very important. We emphasized some specific actions that need to be undertaken. Are those new? Yes, partially. Will I tell you about [them]? Of course not,” said Ashdown.

NTV Hayat, RTRS – Del Ponte confirmed that she will meet with RS Minister of Interior Darko Matijasevic but wouldn’t say where or when.

RS Government’s officials object HR-proposed future police organization

 

TV PINK, RTRS – Resigning RS PM Dragan Mikerevic thinks that the RS Interior Ministry, together with its minister, police director and police structures financed from the RS budget that would work in accordance with the Constitution and Law on Internal Affairs of this entity, need to be a part of any future structure of police forces in BiH. Spokesperson for the RS PM, Goran Radivojac, said that only a police structure that would “go along the administrative boundaries and the organization of district prosecutions and courts,” can be accepted. Mikerevic’s stance is that PRC completed its work without reaching consensus.

Glas Srpske cover page story ‘We will not violate principles’ – Dragan Cavic, RS President, on Tuesday stated that the proposed police reorganisation model was not acceptable, since it included IEBL crossings, which is also the boundary line of administrative and territorial authority between entities. Cavic said: “We are ready for compromises, but we are not ready to support the compromise reached between Bosniaks and Croats and to say – you agreed and we should violate all the constitutional and other principles to satisfy your needs.”

Brcko District opposes proposed police organizational map

 

Dnevni Avaz pg 4 ‘HR’s decision is not in accordance with arbitration’ by E.R. – In a statement to DA, the Brcko Mayor, Mirsad Djapo, commented that the HR decision on police structure not including the region of Brcko is not in accordance with the arbitration decision on this District. “I will demand from Government and Assembly to discuss this proposal,” said Djapo adding “police reform will be a good occasion for comprehensive analysis and establishing of District’s strategy towards BiH institutions.”

RHB – The Chair of the RSNA Board for supervision of security organizations, Velimir Sakan, feels that all police reforms need to be harmonized with the BIH and Entities Constitutions. Attorney Miroslav Mikes commented that the police reform has political motives so entity borders could be breached. SNSD General Secretary Igor Radojicic feels that the police organizational structure is not a done deal and that legal procedure needs to be respected.

Oslobodjenje pg 7 ‘Obligating pressure’ by O.Vukovic – SDS member, Momcilo Novakovic, stated that the decision on police structure is a pressure and a trial to impose the solution.

BHT 1, Glas Srpske pg 5 ‘To reject proposal’  – The Coordination Board of the 11 RS NGOs said they will request referendum on RS separation if Paddy Ashdown’s proposal on BiH police’s territorial organisation is adopted, stated said their representative, Branislav Dukic.

Marko Pavic, DNS leader, is of the view that the proposal on police reorganization leads towards abolishment of the RS MoI and creation of a single police force at the BiH level.

According to a military-political analyst, Ostoja Barasin, “by the latest decision on territorial organization of Police in BiH, HR Ashdown did not abolish the RS MoI, however he abolished the entity’s Police, which is yet another anti-constitutional act”.

RTRS, Oslobodjenje pg 2 ‘The biggest RS enemy is those ruling it’ by O. Vukovic, Glas Srpske inset ‘What about human rights’ – Branko Todorovic, President of RS Helsinki Board for Human Rights, has stated that HR’s decisions have nothing to do with democracy and human rights.

SDA stands for 5 police regions

 

Dnevni Avaz pg 4 ‘SDA stands for 5 regions’ – SDA believes that the proposed map of 10 police regions reflects an unprincipled compromise and represents a deviation from the principle of professionalism and efficiency. “This can best be seen in the example of the police region with a seat in Foca, RS, instead of Gorazde, FBiH, which meets all the conditions, and the fact that the Sarajevo police region is reduced more or less to the city centre,” an SDA statement says. The SDA supports the map with five police regions and will advocate for the police regions to be harmonized with the regions covered by other law enforcement agencies.

Dnevni Avaz pg 5 ‘The BiH Interior Ministry will be established’ – In an interview with the daily, Mehmed Zilic, a members of the Police Restructuring Commission, also advocated for the establishment of a single BiH police structure with five regions.

NTV Hayat – SDA Vice President, Elmir Jahic comments on choosing Foca as one of the centres: “The only preconditions it has met is to become logistic basis for hiding war criminal Radovan Karadzic.” 

SDP supports 5 police regions, HDZ proposes judicial reform to follow police

NTV Hayat – SDP also believes that the police division in five regions would be the best solution. SDP representative Damir Hadzic comments: “The proposal on 5 regions presents the best solution when it comes to professional standards, since it meets generally accepted standards. By 5 regions, the full effect is accomplished, and the facts which exist and which no one can deny are being respected.” HDZ believes that the implementation of the new police structure will start soon and that BiH is going to have the police in accordance with European standards. But still, they believe that some corrections should be made. HDZ Chair Barisa Colak said: “My opinion is that it is impossible to organize the police if it is not functional at the same time, and if the organization [is not followed with the judicial] reorganization. I think that this solution is optimal and that it can offer some good results.”

CoM Chair Adnan Terzic told journalists after the session that ministers who resigned presented their reasons for making that decision. He added: “We need to wait for the establishment of the RS Government [in mid February] in order to know exactly which political structures will continue to participate in the CoM.”

BHT 1 – “This [CoM] session has certainly not resolved the issue of withdrawing resignations. In the time ahead of us I think that we shall need a lot of political wisdom and strength to resolve the issue of resignations”, stated Terzic.

PINK – Terzic also said that he will not start the procedure to relieve Mladen Ivanic, Branko Dokic and Zoran Tesanovic of their duties. CoM Chair stressed that the best solution for the crisis in BiH CoM would be for Cabinet to continue its work in this current composition. During the CoM session, it was concluded that all crucial projects in BiH should be led by the BiH Government and not OHR, and that it should present a stimulus to ministers in resignation to return to the Council and continue working as a team.

Dokic: Resignations are not final 

 

FTV, BHT 1, Dnevni Avaz pg 2 ‘Resignations not definitive’, SRNA – BiH Minister of Transport and Communications Branko Dokic said on Tuesday that his resignation and the resignations submitted by his PDP colleagues BiH Foreign Minister Mladen Ivanic and BiH Deputy Minister of Civil Affairs Zoran Tesanovic were not definitive. According to Dokic, the resignations might be withdrawn if the reasons for their submission are removed. This particularly refers to making of the crucial decisions outside state bodies including the Council of Ministers.   

PINK, RTRS –BiH Foreign Minister, Mladen Ivanic, stated after the CoM session that the legal deadline to relieve him of duty has already started and that Adnan Terzic has 30 days to take a stance on this issue. However, Terzic said that “the law does not stipulate the deadline in which Chair of BiH CoM has to declare himself on resignations”, adding that the “resignations are a matter of political discussions.” Mladen Ivanic doesn’t agree with Terzic’s comment: “Read the law, and there you will see an article which states that when a minister submits resignation, the new one should be elected and in accordance with the article 10 this situation cannot last forever.” 

NTV Hayat Ivanic said “We have submitted our resignations, they have not been withdrawn, the deadline to relieve us of duty has started and it is up to others to overcome the crisis.”

OHR welcomes CoM session

 

NTV Hayat, FTV – OHR welcomes the meeting of the Council of Ministers, reminding that there is a huge amount of work for the CoM to do as seven laws still have to be adopted and sent to Parliament for enactment if BiH is to meet the requirements of the EC’s Feasibility Study.

PINK– OHR spokesperson Oleg Milisicsaid:“BiH CoM has a number of issues that should be solved today [Tuesday], such as the law on public broadcasting system… CoM’s task is to discuss on laws and to submit them to Parliament’s procedure.”   

SNSD: ‘End of PDP show’

 

RTRS, FTV, Dnevni Avaz pg 12 ‘Agreement breached’,Nezavisne Novine pg 5 ‘SNSD: The end of fake PDP show’; Glas Srpske pg 2 ‘The end of fake show’ – SNSD on Tuesday released a press statement, criticising the PDP ministers for having attended the session of the BiH COM. SNSD press release reads that decision of PDP Ministers represented an end of the fake PDP show on alleged protection of the national interest.

DL says CoM hostage of RSNA

 

Dnevni List, pg 5, mentioned on front ‘Council of Ministers is hostage to RS National Assembly’, by Mensud Zorlak – DL notes that considering the fact that the full and normal functioning of the BiH CoM depends on the outcome of the story regarding the crisis in the RS NA, it would be logical to conclude that BiH is taken hostage by the RS NA.

Terzic get green-light to demand return of Algerian group

 

TV PINK, BHT, RTRS, NTV Hayat, Dnevni Avaz pg 2 ‘Three draft laws from Feasibility study adopted’ by F. Cardzic– BiH Council of Ministers Chair, Adnan Terzic, received a green light from the CoM to request from the USA to return to BiH four BiH citizens from the so-called “Algerian group” held in the US military prison at Guantanamo base if no process is being conducted against them. Terzic explained that request would be sent after determining if these members of the “Algerian group” passed the process of reviewing their citizenship. “CoM allowed me to ask USA authorities to return BiH citizens to BiH, if no process has been conducted against them. We concluded that it should be confirmed whether the prisoners went though the citizenship revision procedure positively,” said Terzic.

CoM adopts draft Public Broadcasting System Law

 

BHT 1, RHB– At the session held on Tuesday, the BiH Council of Ministers adopted the draft law on BiH Public Broadcasting System, which includes amendments from both Parliament’s Houses previously harmonized. The draft law will be sent to the urgent parliamentary procedure. CoM also codified the Law on Competitiveness.

BiH Restitution Commission holds 1st session: 1 Jan 1945 established as restitution date

Vakuf-Uskoplje: End to dualism in power’, by D. Pasic – The BiH Restitution Commission held its first session on Tuesday. It was concluded that this Commission should propose by June 1 the working material of the state law on restitution, i.e. returning seized property to owners. The Commission thinks that January 1, 1945 should be taken as the initial date for restitution. The Commission thinks that the restitution should be implemented by providing property or financial compensation to former owners.

TV PINK, Hayat, FTV also carry Chairman of the Commission Mustafa Begic as saying: “Over 600 000 hectares of land have been taken away from BiH, which presents extremely huge land area, a great number of apartments have also been taken.” Begic added that the restitution process is going to be long, but he said that he was sure that the issue would be resolved.

SDA says indictment against Cengic the result of pressure

 

Oslobodjenje pg 3, mentioned on cover ‘An orchestrated process is being carried out against Hasan Cengic’, Dnevni Avaz pg 4 ‘Judicial institutions should avoid orchestrated political processes’, SRNA – SDA announced on Tuesday that the indictment issued by the BiH Court against Hasan Cengic “is the result of pressure aimed at equalizing aggressor with defender.” “After years of media, political and police pressure aimed at equalizing aggressor with defender, many persons who defended BiH have been prosecuted. The result of this pressure is the indictment of Hasan Cengic, who made a valuable contribution to the defence of BiH,” says a press release. The SDA expects the judiciary to, by conducting objective trials, finally put a stop to this practice and prevent orchestrated political trials.

Trebinje justice accuses OHR of interfering in Alijagic case

 

Nezavisne Novine cover ‘OHR employed influenced decision in “Alijagic” case’ by V. Duka-D. Risojevic – Retired Chairman of Trebinje County Court Slavko Sunjevic claims that OHR exerted pressure against him during procedure in the [Salih] Alijagic case [verdict ordered Trebinje municipality to pay out app. 37 million KM of war compensation to Alijagic]. He claims that the documents regarding the case were taken to OHR, and that OHR employees were present at the trial. Sunjevic says that he was present when the reports were opened by OHR employees and adds that they were very interested in the outcome of the voting in Alijagic case and how did the judges vote. According to Sunjevic, Daniel Ruiz, former OHR employee who left Trebinje after riots in 2001, addressed him a letter claiming that evidence that Sunjevic required was absolutely irrelevant and only aimed at delaying court proceedings. Sunjevic claims that Ruiz came to the Court 17 times and called 24 times so he can influence the case.  Sunjevic also claims that during the selection of judges, the OHR took into consideration the facts as to what judge voted for what outcome of Alijagic case, i.e. those who voted in the interest of Alijagic were selected.

RTRS – OHR did not comment to the accusations. OHR spokesperson, Vedran Persicsaid: “The case is before of the court and OHR cannot comment it.” Appearing in RTRS’s political magazine ‘Pecat’, Alijagic denied he bought a house for Ruiz in Dubrovnik and stated that he met Ruiz when the trial began. RTRS showed at the time a picture of Alijagic and Ruiz taken in Sweden on 26 January 2001 at the premises of Bosanska Krajina Association at a gathering organised by Trebinje refugees.

Hadzipasic meets Humphreys, discuss return and economy

 

RHB, Oslobodjenje pg 4 ‘2.3 million KM for return program’, Dnevni List pg 3 ‘Hadzipasic: FBiH will honour its obligations’ not signed – Reports that during the meeting between the FBiH Prime Minister, Ahmet Hadzipasic, and Head of the EC delegation in BiH, Michael Humphreys, which was held on Tuesday, it was concluded that the cooperation of the FBiH in meeting obligations related to 16 questions from the Feasibility Study will continue in the coming period as well. The FBiH Government Press Office issued a press release which says that the two talked about the FBiH’s obligations in the process of approaching the EU such as co-financing of the program for return of refugees, passing of the Action Plan for Energy and appointment of the Steering Board members from the FBiH in the corporation in charge of electricity transfer at the level of BiH.

Fuel price to go up

Tulic – President of Section of fuel distributors with the FBiH Economic Chamber, Muhidin Alic, notes that the prices of fuel could again go up starting Monday, because costs of transportation of fuel and in oil refineries have gone up.

PINK, FTV, Dnevni Avaz pg 8 ‘Supervision in Zepce and Gornji Vakuf abolished’ by Fena, Oslobodjenje pg 4 ‘Jurisdiction transferred to local authorities’ by Onasa– The High Representative, Paddy Ashdown, has informed the mayors of Zepce and Gornji Vakuf-Uskoplje municipalities on the decision to end the International Community supervisory regimes in these municipalities. OHR spokesperson Oleg Milisic noted that the supervisory regimes put in place in 2000 for Zepce and 2001 for Gornji Vakuf-Uskoplje have helped both municipalities to make substantial progress in representing all citizens and providing them with better governance. With this, Milisic said that the time has come to transfer both real and titular responsibility for good governance in both towns to the local authorities.

RTRS, Nezavisne Novine cover and pg 2 ‘Cavic demands review of all decisions of RS Government’ by D. Risojevic Dragan Cavic, RS President, on Tuesday addressed a letter to the outgoing RS Premier, Dragan Mikerevic, in which Cavic criticises Mikerevic’s statements related to RS-PM designate. Cavic has also demanded from Mikerevic to deliver all the decisions RS Govenrment has passed after it has resigned, so he himself could review them. According to NN source close to RS Government, Cavic has also warned Mikerevic not to even think about issuing tender for the sale of strategic companies.

DNS will not support Bukejlovic

Commenting on the journalist’s conclusion that HR Paddy Ashdown is also among those who do not want to admit that BiH is currently faced with the authority crisis, Dizdarevic says: ‘We have not found too much happiness with the current HR and I believe that his whole mandate was marked by wrong estimations and moves. He wants to keep BiH as a dependent and not turn it into a self-sustainable state and prepare withdrawal of the international factors from BiH. I am certain that BiH is not mature yet to be deprived of the HR’s services as an institution but I believe that Mr. Ashdown is not the person who might help BiH under current circumstances.
