Serbian Justice Minister tells Bosnians to stop raking up the past, drop lawsuit

FTV, RTRS, Blic pg. 3 ‘BiH to withdraw lawsuit’, Vecernje Novosti pg. 4 – ‘Serbs were murdered too’, Nezavisne Novine, pg. 3, ‘Call on BiH authorities to withdraw lawsuit against Serbia and Montenegro’; Glas Srpske, pg. 3, ‘Belgrade opens cards’, Dnevni List page 2, unsigned, “Batic: call to BiH authorities to drop charges against S&M” – It would be best, for the sake of good neighbourly relations, if BiH were to withdraw the lawsuit for war damages against our country, but if it does not, Serbia has documents for a counter-suit, Serbian Justice Minister Vladan Batic has said. The Justice Ministry, within which the committee for gathering data on crimes against humanity and international law is now operating, has over 100,000 documents, of which 70 per cent relate to crimes committed against Serbs in BiH. This is evidence of persecution, ethnic cleansing, torture, murder, rape and camps for Serbs, Batic said. He said that the ministry had documents about 540 camps for Serbs in BiH, about 453 Serbs murdered in Srebrenica, and a pile of evidence about the crimes committed by the Mujahedeen, which could be listed under genocide. Batic said that 432 witnesses were ready to testify before The Hague Tribunal. This is our response to the statement made by the BiH minister for civilian affairs, Batic said, and reiterated: “It would be good if the BiH Federation were to withdraw its lawsuit for war damages because we have to think about the future and not keep raking up the past. If the reply is that the withdrawal of the lawsuit is out of the question, well, then our country has to defend itself. Since it has to defend itself, we have to show that the picture of war crimes in Bosnia and Herzegovina is not black and white, as I have already said, but there is also the other side of the coin.” Minister Batic said that, if BiH did not withdraw its lawsuit, Serbia would forward the said evidence to the International Court of Justice in The Hague. It will also enable the Hague tribunal to raise indictments for these crimes, and the evidence will also be forwarded to the special prosecutor for war crimes in Serbia.

No reason for Bosnia to withdraw lawsuit against Serbia and Montenegro – Tihic

FTV, Oslobodjenje pg. 6 ‘BiH did not commit crime in the FRY territory’, Dnevni Avaz pg. 2 ‘BiH was not committing crimes in the territory of Serbia and Montenegro’, Nezavisne Novine pg. 3, Glas Srpske pg. 3, Dnevni List pg. 2 – After Serbian Justice Minister Vladan Batic said that unless BiH were to withdraw its lawsuit against the FRY (Serbia and Montenegro) for aggression and genocide, he would present evidence of crimes committed against Serbs, BiH Presidency member Sulejman Tihic has said that “BiH has not committed crimes on FRY territory or against its citizens,” a statement issued by Tihic’s office says. “I believe that the truth about the nature of the war in BiH from 1992 to 1995, which will be established by the International Court of Justice in The Hague, is a precondition of lasting peace and good neighbourly relations between BiH and Serbia and Montenegro,” Tihic’s statement says. It adds that “there are no reasons for BiH to withdraw its lawsuit against the FRY/Serbia-Montenegro for aggression and genocide, especially since the International Court of Justice turned down the latest objections by Serbia-Montenegro”. “If he has any proof of crimes committed against people and nations of BiH (and not just Bosnian Serbs!) and which took place in BiH, why has he not revealed them yet?! And I shall call on Batic to present them in public and the ICTY. “One thing is certain: neither Batic nor anyone else has proof of BiH committing crimes on the territory of the FRY/Serbia-Montenegro or against its citizens, which is the only relevant thing in this case. Batic also forgets that Serbia and Montenegro is not authorized to look after the citizens of BiH, that is, represent Bosnian Serbs, because their state is BiH,” says the statement by Tihic.

FTV, Dnevni Avaz pg. 2 ‘Documents which Batic is threatening with are not reson to withdraw lawsuit’ – Sakib Softic, the BiH Agent in proceedings BiH against Serbia and Montenegro, said that the documents being mentioned by the Serbian Justice Minister were offering no new evidence and they therefore could not be a reason for withdrawal of BiH’s lawsuit.

Bosniak Presidency member urges Serb officials to reveal mass grave locations

Croat Radio Herceg Bosna, FTV, RTRS, Dnevni List pg. 9, Oslobodjenje pg. 6 ‘Bodies of 17,000 Bosniaks exhumed in BiH’, Dnevni Avaz pg. 3 ‘RS authorities stand behind crime on Crni Vrh’, Nezavisne Novine, cover and pg. 3, ‘Republika Srpska authorities must name all locations of mass graves”; Glas Srpske, pg. 3, ‘He accuses Srpska’ – BiH Presidency member Sulejman Tihic said on Tuesday, after visiting the Crni Vrh mass grave near Zvornik, that “without a doubt the RS authorities are responsible for this crime”. “I am astounded by the number of crimes committed which were, obviously, organized by and systematically involved dozens if not hundreds of people. Without a doubt the RS authorities are responsible for this crime,” Tihic said, according to his cabinet office. Tihic also said that “all those who support this kind of RS have to accept the fact that it came about as a result of the aggression on BiH and that it is founded on genocide and ethnic cleansing”. The report cites Tihic, following his visit to Crni Vrh, calling on the high-level officials of the RS, both former and present, Dragan Cavic, Dragan Mikerevic, Dragan Kalinic, Milorad Dodik, Mladen Ivanic and others, to reveal the “location of the other mass graves”. The Bosniak member of the BiH Presidency claims that in the Zvornik region alone there were 35 mass graves in which 6,000 victims are buried. Tihic also called on the international community, above all the OHR and the EU Police Mission, to exert pressure on the RS authorities in order to finally reveal the location of the remaining mass graves in this entity and to prosecute those responsible for these crimes.

Paravac slates colleague’s genocide remarks

FTV, RTRS, Oslobodjenje last page ‘Paravac condemns Tihic’s statement’, Dnevni Avaz pg. 3 ‘RS is expression of Serb people’s will’,Dnevni List page 2, by Fena, “Paravac: Tihic’s accusations do not contribute to development of BiH”, Glas Srpske page 3 ‘Nation said what it wanted’, Nezavisne Novine pg. 3– Member of the BiH Presidency, Borislav Paravac, warned on Tuesday that Presidency member Sulejman Tihic’s labeling of the Republika Srpska as a creation of genocide did not contribute to the prosperity of BiH. In a written statement Paravac stresses that this type of labeling does not greatly contribute to efforts to create a democratic society and the functioning of BiH as a law-governed state, which is the only way for BiH to have a future. “I would remind Mr Tihic that the RS was created before the war – on 9 January 1992 – by the political will of the elected representatives of the Serb people in order to protect the people from outvoting in then Bih and that the RS was defined by the Dayton Agreement as one of the two equal entities in BiH,” the statement stresses. Paravac adds that all crimes committed in BiH should be uncovered and their perpetrators punished, whether they are responsible for Srebrenica and Crni Vrh or Kravica, Kazani and Silos. “Only the full truth about all the victims can contribute towards reconciliation and ensure that such crimes are never repeated,” the Serb member of the BiH Presidency concludes.

OHR forwards draft law on indirect taxation system to BiH Council of Ministers

Croat Radio Herceg Bosna, FTV, Dnevni List page 5, Oslobodjenje pg. 6 ‘Eliminate frauds, increase income’, Nezavisne Novine, pg. 4, ‘BiH draft law on indirect tax system forwarded’,FENA – High Representative Paddy Ashdown forwarded the draft law on the indirect taxation system in BiH to BiH Council of Ministers Chair Adnan Terzic, OHR Spokesman Kevin Sullivan said at a press conference in Sarajevo on Tuesday. He said that the law is a result of intensive negotiations and consensuses in the Indirect Taxation Commission between

representatives of the BiH Council of Ministers, entity governments and Brcko District over a four-month period. The regulations from the law, approved by the three ministers, have been harmonised with International Monetary Fund, World Bank, and European Commission standards. The draft was developed in BiH and

was agreed by BiH representatives and it will now be forwarded to the BiH Parliament for adoption, Sullivan said. The law regulates the establishment and functioning of the Indirect Taxation Administration, which will collect and distribute revenue from indirect taxes in BiH in accordance with highest professional and ethnical standards. OHR stated that changes introduced by this law are complex and will require time to provide specific results. Once adopted the law will represent the key first step needed for cleaning up the BiH taxation system and ensuring that it works in an appropriate way.

Terzic and Hays to visit Central Bosnia Canton on Thursday

Dnevni Avaz pg. 8, FENA – BiH Council of Ministers Chair Adnan Terzic and Principal Deputy High Representative Donald Hays will visit Central Bosnia Canton Thursday, OHR spokesperson Kevin Sullivan said at a press conference in Sarajevo on Tuesday. During the visit to this canton they will take part in a roundtable gathering representatives of business community in Central Bosnian Canton, as well as cantonal, Federation and state officials. Terzic and Hays will discuss what need to be done on implementation of reforms agreed at the meetings on Bjelasnica and Mrakovica. The authorities made a commitment to intensify efforts on increasing

export, cleaning up the environment for business and restarting the privatisation process by the end of the year, Sullivan said and reminded that businesspersons would be requested an opinion on how this could be done in the most efficient manner.

VL says Hercegovacka Bank to open tender this week

Vecernji List (front “Hercegovacka bank soon goes to tender” and page 3 “Bank interesting to foreigners”, by Zdenko Jurilj) – reports that the Provisional Administrator for Hercegovacka Bank, Toby Robinson, at a meeting with senior officials of the bank held on Tuesday, promised that this week an international tender on sale of the bank would be opened this week. Reportedly, the tender will be published in all domestic and foreign papers. Regarding potential buyers, VL does not mention names but says that rumours are that some Italian, Austrian as well as German financial companies are interested.

DL’s editorial on Corridor Vc

Dnevni List (page 6, by Professor Marko Tadic, “Is Corridor Vc only economic issue?”) – the author argues that the issue of construction of Corridor Vc has become one of top political issues in BiH, disagreeing with the High Representative for BiH, Paddy Ashdown, who said during his last visit to Zagreb that he did not want to interfere because it was an economic and not political issue. “He has interfered into less important economic and political issues”, comments Tadic. To substantiate his claim that it is about the political issue, Tadic claims that majority of Bosniak parties are supporting the latest decision by the BiH CoM whilst, according to Tadic, Croat and Serb parties in BiH are more in favour of inviting an international tender to build the road, also citingtwo headlines published in “Oslobodjenje”: “HDZ wants to dispute negotiations on highway with Bosmal” and “HDZ pushes only Racan’s offer” to fortify his claims.

Wheat import

Blic pg. 7 ‘People will be full up and poisoned’ – As a result of a huge draught, BiH will have to import 300,000 tons of wheat from the USA in the next period. However, there is a feat that imported wheat will not be of a good quality, since that it is genetically modified. It is expected the prices of bakery products will increase in forthcoming period.

Telekom Srpske update

Nezavisne Novine, cover and pg. 3, ‘Telekom Srpske bought the premises for KM 2.5 million, but is still paying a rent’ –The Office of Telekom Srpske in Prijedor is still operating at the premises of Srpske Poste, to which it pays a rent of KM 6300 per month for 700 square metres, although Telekom has purchased the business premises in the former Prijedor Bank building. This space was bought for KM 2.5 million and the payment procedure completed in May 2002. 

Update to RS pensioners’ problems

Glas Srpske, cover page story, ‘To collect check at border!’ – The Republika Srpska pensioners plan to block border crossing points at the end of this month. The reason for this is a constant refusal of the Federation of Bosnia and Herzegovina to implement decision of Human Rights Chamber, according to which the pensions should be paid to pensioners by entity where they were earned. The deadline for the implementation of this decision expired on 10 July.

Problems in Bocac power plant

Glas Srpske, cover page story, ‘Turbines without water’ – The inflow of water into the accumulation lake of the hydroelectric power plant “Bocac” has never been lower in the past 20 years since this plant at Vrbac was built. The drought caused a drastic reduction of power production. The representatives of Bocac plant claim that only 40% of the August plan for power production will be met.

 

 

Political developments

FBiH Ombudsmen recommend FBiH Government to annul the decision on removing steering boards

Croat Radio Herceg Bosna, FTV, FENA, Dnevni Avaz pg. 4 ‘Ombudsmen request Government to annul the decision’ – FBiH Ombudsmen Vera Jovanovic, Esad Muhibic and Branka Raguz forwarded to the FBiH Government the Findings, Conclusion and Recommendation to annul its Decision from July 17 on removal of all presidents and members of steering boards in companies with majority state capital in the fields of energy, mining, industry, traffic and communications, agriculture, water-culture, forestry, and trade and the decision on appointing of provisional steering boards in the mentioned companies, according to a press release issued by the FBiH Ombudsmen Office. The Ombudsmen fortified that the Government issued the Decision generally for all companies without argumentation, “and thus violated the principles of legality, quality, openness and transparency in employment”. The Decision on removal of steering boards is a consequence of inter-partisan agreement, and not the full implementation of the Law, according to the Ombudsmen. Thus, the Ombudsmen conclude that this removal procedure was not applied in the proper and correct manner therefore recommending its annulment.

Vecernji List page 2, by Fena, “Annulment of Government’s decision on steering boards“, Dnevni List front and page 3, “FBiH Government has to annul decision“, by J.P. also carry that the Federation of Bosnia and Herzegovina Ombudsmen have sent an analysis, conclusion and recommendation to the FBiH Government to annul its decision on dismissal of presidents and members of the steering boards of the public companies passed on July 17, 2003. VL says that having in mind the fact that the Ombudsmen are the longer arm of the OHR, it is certain that the OHR will accept this decision and this means that High Representative, Paddy Ashdown, will pass the decision on the annulment. In an addition to the aforementioned article DL carries on the same page (not signed, “Kukic: Recommendation of ombudsmen was expected and it is logical“) the President of HT Mostar Supervisory Board, Slavo Kukic,who says that such Ombudsmen’s conclusion was expected and logical. He added: “The things that Ashdown did ten days ago and the things that FBiH Ombudsmen have done now is light at the end of the tunnel and ray of optimism that an end will come definitely to political self-willingness and anarchy.”

Dnevni Avaz pg. 4 ‘Premier Hadzipasic: We will make our stand on the recommendation tomorrow’ – The FBiH Prime Minister Ahmet Hadzipasic told the newspaper that he had forwarded the Ombudsmen’s recommendation to the authorized ministries and bodies for the consideration and that the Government might make its position on the issue at its next session scheduled for tomorrow.

DL: Interview with SDHR Wnendt

Dnevni List (front and page 7, by Ivica Glibusic, “Issue of Mostar is obstacle to BiH road to EU”) – an interview with the Senior Deputy High Representative, Werner Wnendt. Questioned what is the main obstacle to BiH joining the EU faster, SDHR Wnendt says the main problems are in the areas of economy and rule of law. “BiH must undergo serious reforms in the fields of fight against the crime and corruption. A lot of funds go into hands of criminals instead on teachers, pensioners, health workers and other vulnerable social groups”, says SDHR Wnendt. Questioned to comment on the issue of Mostar, SDHR Wnendt says that the Mostar issue i.e. adoption of the new Statute, is one of obstacles to BiH road to the EU and that parallel structures and wasting of money does not help en route to the EU. “What is important in the Mostar case is that everyone must be guaranteed the same rights”, comments SDHR Wnendt. He goes on to say that the 8 principles stay unchanged and says: “What we have in the next few weeks are consultations with all relevant political factors in Mostar in order to solve the situation. As you most probably recall the High Representative has said that we are in the listening mode trying to help Mostarians in finding of the compromise solution. Compromise means pain, giving up and confidence building measures and above all sincerity to find a solution for the benefit of Mostar citizens. Again let me mention the necessity of equal opportunity which must be guaranteed at local level.”

 

Ivanic: There will be no early elections in BiH

Croat Radio Herceg Bosna, RTRS, Oslobodjenje pg. 4 ‘There will be no early elections in BiH’, Blic pg. 7 ‘No changes in the Srpska Government’, Dnevni List page 10, by F, “Announcement of removal of RS PM ‘media speculation'” – PDP President Mladen Ivanic described on Tuesday as “media speculation” recent announcements of a possible replacement of RS Prime Minister Dragan Mikerevic. “Personal changes cannot improve the existing difficult situation in the RS and therefore I welcome the initiative of RS President Dragan Cavic to organise a meeting of leaders of ruling parties in August to agree a new concept of functioning of the RS”, Ivanic told a press conference. Ivanic said that demands for the dismissal of Mikerevic and his Government are “understandable in a country struggling with a difficult economic situation”, but stressed that personal changes alone would not lead to quick economic recovery which all citizens expect. He confirmed that there are “differences, even tensions” between parties in the RS ruling coalitions, but that they are not such that they could put at risk the functioning of the coalition. Commenting on the opposition’s initiative for early elections, Ivanic said that was a wish for power, adding that early elections would change neither the political nor the economic situation in the RS and BiH and concluded that such an initiative would not receive the support of the international community.

Glas Srpske, pg. 2, Nezavisne Novine, pg. 4, ‘PDP will support recommendations of auditor’ – Mladen Ivanic, PDP President, yesterday also stated that PDP will strongly support report of international auditor into business dealings of Telekom Srpske, as well as the implementation of eventual recommendations.

He denied accusations, including those by Milorad Dodik about alleged illegal privatisation of Telekom with European Bank for Reconstruction and Development (EBRD). On this, he said that: “I am glad to see that the alleged illegal activities are connected with EBRD, which is not commercial bank but the bank of European states’ governments. This accusation is absurd and no explanations should be given on it at all.”  

 

SDS on Dodik’s claims

Glas Srpske, pg. 2, ‘Dodik has a large account’; Nezavisne Novine, pg. 4, ‘SDS claims it occupied the SNSD place’ – Following the accusations of Milorad Dodik, SNSD leader, published in Nezavisne Novine and Dnevni Avaz, SDS yesterday released a press release, saying that “pathological hatred of the SNSD leader towards SDS has nothing to do with the existing authority composition in Republika Srpska. It rather originates from the fact that at the local scene and international circles, SDS has taken over the seat, which used to be reserved for Dodik and his party”,

SDS further stresses that for some time, Dodik has turned into a figure fatal for Republika Srpska, but also for his own party lately, because he is isolating it and leading it into disaster.

 

SNSD on ‘Ivanic’s fear’

Glas Srpske, pg. 2, ‘Truth should be revealed’; Nezavisne Novine, pg. 4, ‘SNSD denies Ivanic claims’ – According to press release yesterday issued by SNSD, the latest lies spoken out by Mladen Ivanic, PDP leader, against Milorad Dodik, SNSD leader, only speak about Mr. Ivanic and his fear. Mr. Dodik understands his fear and existence of justification for it, press release stresses.

Paravac on constitutional changes

 

Dnevni List (page 10, unsigned, “Serbs do not accept change to Constitution of BiH”) – reports that the Serb member of BiH Presidency, Borislav Paravac, stated that he was certain that in some senior circles of the IC were still political forces that peoples in BiH should be left to materialize one of the fundamental rights guaranteed by the Helsinki charter – the right to self-determination. “We are still not lobbying for the idea, because we believe that the Serb people can materialize its interests in this kind of BiH in which the RS, as a guarantee that the majority of Serb interests will be protected, exists. Our legitimate right is to defend the existence of the RS, its institutions, and by defending that right, we defend the Constitution of BiH. If somebody thinks the right can be deprived, he/she should let us to check whether the current Constitution of BiH should be changed and in what direction”, said Paravac.

EUPM on series of explosions

Croat Radio Herceg Bosna, BHTV – EUPM said that the recent series of explosions in Sarajevo were unacceptable, adding that they have been closely monitoring police investigations into the cases.Spokesperson for EUPM Jon Oscar Solnes explained at a press conference in Sarajevo on Tuesday that EU police mission has no mandate to conduct investigations, but will offer all assistance and advice required to the FBiH and Cantonal MoIs. He also stressed that EUPM officials have been in regular contact with MoIs to discuss overall security situation.

Oslobodjenje pg. 5 ‘EUPM: Incidents on ethnic basis will not be tolerated’ – “Efficiency in fight against organised crime including human trafficking and incidents provoked on the ethnic basis are of a particular strategic importance for the EUPM,” said Solnes.

Dnevni List (page 4, by S. Kuzman) carries that the EUPM issued a press release yesterday which confirmed that EUPM Commissioner Sven Frederiksen sent a letter to the Minister of Interior of the Federation of Bosnia and Herzegovina in which the Minister is kindly asked to raise a few administrative issues that have to be completed in order to reach a higher degree of professionalization of the FBiH Police. The press release also says that the EUPM has already noticed progress with regard to large number of issues, however, they stress that they will closely watch the future development. The press release underlines that the EUPM is aware of a series of explosions that have taken place in the Sarajevo region lately, and that the EUPM is closely monitoring the Police response. Sarajevo dailies also covered the issue.

Another explosion in Sarajevo

Dnevni List (page 41, by E. Mackic, “”) – the daily reports that there was another explosion in Sarajevo, this time two nights ago when a bus, parked in the Sarajevo district of Mojmilo, got completely destroyed. According to the spokesperson of Sarajevo Canton Ministry of Interior, Ljiljana Sakic, the type of explosive which was used will be known after further forensic procedure has been carried out.

Slobodna Dalmacija (page 13, by Zlatko Tulic, “Domestic Mafia ‘imported’ bomb-thrower from Montenegro?”) – the daily reports that some information say that within the investigation about the recent incidents in Sarajevo, the Sarajevo Canton Police Commissioner, Himzo Selimovic, and other senior officials of the cantonal and FBiH MoI, received an information that a “dangerous person” from Montenegro arrived to Sarajevo. Allegedly, an operation in order to capture this person and the ordering party is ongoing. SD also says the recent attacks do not have national background and are most probably related to Mafia.

DL on Zoran Cegar case

Dnevni List (front and page 4, “Decision of FBiH MoI Disciplinary Board on Friday at 10 o’clock”, by De.L.,) carries that a source close to the EUPM confirmed for DL that cross examination of two witnesses in politically contrived case of Commander of the Special Police Unit with the Federation of Bosnia and Herzegovina Ministry of Interior, Zoran Cegar, was completed in Sarajevo yesterday. According to the same source, witness Tabakovic did not confirm alleged Cegar’s curses and he kept silent on the most questions posed by the Disciplinary Board and Cegar himself. The source said that the Cegar’s suspension will be abolished on Friday at 10 o’clock and that he will return to his position. DL says that the interest of BiH citizens is that the Special Police Unit starts with its work as soon as possible so they can feel safer. Dnevni Avaz pg. 2 also covered the issue.

Four Republika Srpska policemen falsified documents

Nezavisne Novine, pg. 2, ‘Four Republika Srpska policemen falsified documents’ – Banjaluka PSC has filed a report on criminal act to the Banjaluka Prosecutor’s Office. The report is on criminal act of forgery of documents, believed to be performed by four local police officers from Srbac, namely Marko Bosancic, Mihajlo Malbasic, Zoran Vidovic and Zoran Kresojevic. The documents falsified were about the origin and sale of three vehicles, which were, upon this documentation, registered at Srbac Police Station.

Citizens named Danko and Nada Vuckovic were also involved in this criminal act.

Possible deployment of BiH troops in Iraq

 

Croat Radio Herceg Bosna, Nezavisne Novine, pg. 3, ‘BiH Presidency to decide on deployment of BiH soldiers in Iraq’ – Mladen Ivanic, BIH Foreign Minister, on Tuesday stated that BiH is considering the possibility of deploying its peace troops in Iraq. According to Ivanic, such a move would send a strong message about the stability inside BiH”.

Oslobodjenje pg. 3 ‘Americans wants to see BiH soldiers in Iraq?’ – The BiH Standing Committee for Military Matters has entered into a phase of serious preparations ahead of possible sending of BiH troops to Iraq in the framework of the international peacekeeping mission in the country.
