Minister Pecelj fails to implement High Representatives Decision

Senior Deputy High Representative  Ambassador Dr.  Martin Ney,  in a letter sent today to RS Prime Minister Pero Bukejlovic, reminded the RS Prime Minister of the continuing violation of the High Representative’s Decision of 30 June 2004 removing Radomir Lukic from the SDS Main Board and all other public posts, including that of Dean of the Law Faculty  at  the University of East Sarajevo. 

“The failure of the institutions of Republika Srpska to take the necessary steps to enforce the decisions of the High Representative cast doubts on the ability of RS Government and its Ministries to carry its obligations. The  RS Education Minister, Milovan Pecelj, has persistantly failed to take any steps to prevent clear violation of the law allowing Radomir Lukic to exercise, without any interference, the offices of Dean and Professor of the Faculty of Law in the University of Eastern Sarajevo”, said Ney. 

“The primary responsibility  for ensuring the implementation of  a Decision made under the High Representative ‘s Dayton mandate lies with  the appropriate BiH Institutions, in this case, Minister Pecelj,  whose duty it is to exercise political and administrative supervision over the work of the University and other Higher Education Institutions” said Ambassador Ney. 

The Minister’s failure to act may jeopardise the legality of the work of the Faculty of Law  at East Sarajevo  University because Minister Pecelj and Dean Lukic  have chosen to  place their  own personal interests  above those of the students.

“Failure by members of your government to take the action by October 10 ,  the start of the Academic year ,  will force us to take robust action against those  primarily responsible for the  failure to uphold the provisions of the Dayton Peace Agreement” concludes Ambassador Ney in his letter . 

In a telephone conversation with Pecelj, Ambassador Ney made it abosultely clear what is expected from Pecelj by Monday, 10 October, if he does not want to suffer consequences.
