THE INDEPENDENT JUDICIAL COMMISSION (IJC)

The Independent Judicial Commission (IJC) is the lead agency for the co-ordination of judicial reform in Bosnia and Herzegovina (BiH). It provides opinions and advice to Ministries of Justice, judges, prosecutors, court administrators and members of the international community regarding the process of judicial reform and the promotion of the rule of law, and serves as a focal point for international assistance to judicial reform initiatives. The IJC also has the power to intervene in the processes of entity and cantonal commissions/councils responsible for selecting and disciplining judges and prosecutors, and the one-time judicial review process. The IJC field offices are located in Banja Luka, Bihac, Mostar, Sarajevo and Tuzla.

PURPOSE AND SCOPE OF POSITION

The Senior Judicial Reform Officer in M&I will maintain primary oversight of domestic Commissions and Councils in the Federation and Republika Srpska established to provide independent recommendations on the appointment, discipline, and review of judges and prosecutors, and providing insight on the day-to-day activities of the independent authorities. The Senior Judicial Reform Officer will also assist the Director and the Chief of the Department in formulating advice to the High Representative on matters relating to the appointment, discipline, and review of judges and prosecutors, as well as members of associated structures. The Senior Judicial Reform Officer will report on the status of operations of the Commissions and Councils, and other independent domestic judicial authorities. The incumbent will work under the general supervision of the Director of the IJC and under the Direct Supervision of the Chief of the Monitoring and Implementation Department.

DUTIES AND RESPONSIBILITIES

Supervision and Coordination

  • Maintaining primary oversight of IJC Field Offices activities

  • In consultation with the Department Chief, coordinating the activities of Judicial Reform Officers in the field concerning the monitoring of the work of the Commissions/Councils, and developing strategies necessary to assist field offices in performing their duties competently and in accordance with the mandate of the IJC

Policy Development

  • Assisting the Chief of the Department and other JRO’s in the formulation of advice on matters relating to the appointment, discipline and review of judges to the Cantonal Commissions/Councils, Cantonal ministries of justice and appointing authorities regarding the statutory and internal procedures regulating the appointment, discipline, and review of judges and prosecutors

  • Assisting the Chief of the Department in formulating advice to the High Representative on matters relating to the use of powers to impose legislation or to remove officials

Project Development and Planning

  • Providing guidance on the identification and implementation of judicial reform projects at entity and cantonal level that promote the independence of judges and prosecutors and develop the professional regulation of judges and prosecutors

  • Assisting the Chief of the Department in reporting and planning on issues within the mandate of the department.

PROFESSIONAL REQUIREMENTS / QUALIFICATIONS

  • Minimum 5 years post-degree professional experience required, preferably in a practical legal setting

  • Experience with European systems and norms preferred

  • Academic or policy experience desirable, particularly with European and International systems

  • Drafting ability

  • Mature judgment

  • Ability to take initiative and work independently
