OHR urges BiH Parliament to adopt legal amendments on war crimes trials

OHR’s press release reads: “The OHR is concerned that this sends a very negative signal with regard to BiH’s determination to co-operate fully with The Hague. The proposed amendments to BiH’s Courts, Prosecutors Office, Criminal Code and Witness Protection laws – if dealt with under urgent procedure – would enable the transfer of cases from the ICTY to the BiH Court’s Special War Crimes Chamber early next year.” The High Representative Paddy Ashdown has asked from parliamentarians to adopt the amendments to mentioned set of laws by the end of month. 

Reactions to OHR’s press release

 

Dnevni Avaz pg 4 ‘OHR set deadline for the end of September’ by S. Skuletic – Deputy Speaker of BiH House of Representatives, Nikola Spiric, stated that the adoption of legislative amendments on war crimes trials in BiH is in interests of BiH citizens, and will therefore receive SNSD’s support. Deputy Speaker of BiH House of Peoples, Velimir Jukic, comments that at the last HoP session there was no willingness among deputies to adopt the mentioned legislation. Sefik Dzaferovic, Deputy Speaker in BiH HoR, believes that the legislation will be adopted by the set deadline, reminding that SDS objected the adoption of the laws in urgent procedure.

Risojevic – RS Prime Minister Dragan Mikerevic told journalists in Mrkonjic Grad on Friday that the RS Government has relevant information on the whereabouts of indicted war criminals in the RS, and stressed that the Government and the RS Interior Ministry are prepared to arrest them. He said that certain limiting factors concerning intelligence existed in the past, but that the situation in the RS MoI was reorganised and teams formed to ensure relevant information on the movement of indictees. Mikerevic said that the RS will have important contacts with neighbouring countries during September and stressed that he is certain that in joint cooperation they will all try to show to the international community that they are not only verbally committed to cooperation with the ICTY.

FTV Fri “I am completely sure that all of us in RS… are completely aware of our responsibility and I expect that RS MoI and other bodies… will give their contribution in meeting our responsibilities,” Mikerevic said.

BHT 1 Fri – Mikerevic stated he expects the response from OHR on proposed two candidates for the position of the new RS Minister of Interior, Darko Matijasevic and Branko Neskovic.

Mikerevic on HR Ashdown’s warning regarding the cooperation with the ICTY

 

RTRS Sat, Dnevni List Sat pg 8 ‘Government has at its disposal information about moving of suspects’ not signed, Slobodna Dalmacija Sat last pg ‘RS Government ready to arrest war crime suspects’ by H – Commenting on the recent warning by HR Paddy Ashdown to RS authorities regarding the cooperation with ICTY, Dragan Mikerevic said that following visits to London and Brussels Ashdown probably received certain information brining into question the accession of BiH to the Partnership for Peace, which could have an extremely negative effect on reforms in BiH. Mikerevic told journalists that probably for this reason the HR again strengthened his request towards the RS to fulfil its commitments.

Cavic says war crimes suspects should be arrested; reports Ashdown to CoE for human rights violations

 

RTRS Fri – While visiting Prijedor, RS President Dragan Cavic stated that he is of the opinion that the RS Interior Ministry and judiciary should find and arrest war crimes accused regardless of their name since RS has a responsibility towards the ICTY. “I am not the one who should go and catch them. Police is doing that. Police has its boss. The boss’s name is the Government and the Government’s Prime Minister. They should do their job and if they are not capable of it they should resign”, says Cavic. RS President also commented to the warning by the HR Paddy Ashdown on possible new sanctions against RS saying that BiH is obviously not capable of protecting its citizens and that Ashdown violates human rights. He added that he informed the Council of Europe on this, and that he expects the visit of CoE’s monitoring team with whom he previously held discussions on this issue. “They are coming in 10 days. I will give them a complete documentation and decisions of the HR with special emphasis to the parts related to violation of conventions that BiH accepted as a member of Council of Europe”, says Cavic.

Ivanic: relations with ICTY must be improved

 

RTRS Fri – BIH Minister of Foreign Affairs Mladen Ivanic emphasises that no one can dispute that cooperation with ICTY is the last big problem for RS. “The relation towards ICTY should be improved in RS because I think that is the last big problem we are facing. After that there cannot be any big political pressures on RS because after that the matters are more or less arranged”, says Ivanic.

Dodik: Ashdown’s warning directed at Njegus and Cavic, but he cannot threat RS citizens

I.  – At the press conference held on Friday in Banja Luka, SNSD leader Milorad Dodikexpressed the view that the latest message of the HR Paddy Ashdown regarding the cooperation with the ICTY represents a warning to those “who failed to fulfil promises”, referring to RS Police Director Radomir Njegus and RS President Dragan Cavic.

Political analyst Topic claims Ashdown to carry out ‘second round’ of removals

Cavic orders MoI to find documents ICTY demands

 

BHT 1 Sat, RTRS Sat, FTV Sat by Onasa, Oslobodjenje Sun pg 5 ‘MoI searches for documents for the Hague’ by Onasa, Vecernje Novosti cover and pg 5 ‘Ashdown threatens it would hurt’ by Slobodan Pesevic– RS President Dragan Cavic confirmed that he issued an order to the RS Interior Ministry to determine location of documents requested by ICTY, referring to transcripts of the sessions of the RS Army Headquarters during the war.  Cavic said that he had contacts with ICTY regarding this issue eight times since March 2003. According to him, the archives of his office are transparent and available, but they do not contain the requested documents.

RTRS Fri – Chief of RS secretariat for cooperation with ICTY, Zivorad Mijatovic, stated that RS Defence Ministry and Army HQ will check their archives within the next 30 days in order to find documents wanted by ICTY. He added that he doesn’t know where the wanted documentation is.

Jazvic, Slobodna Dalmacija Sat pg 6 ‘The Hague transfers some cases to BiH Court’, mentioned on cover, ‘BiH Croats fully cooperate’, by Z. Tulic – A senior BiH Croat delegation met ICTY President Theodor Meron, ICTY Chief Prosecutor Carla del Ponte and General Secretary Hans Holthuis in the Hague on Friday, the BiH Presidency stated. The BiH Croat delegation was comprised of BiH Presidency member Dragan Covic, BiH Security Minister Barisa Colak, FBiH President Niko Lozancic and FBiH Justice Minister Borjana Kristo. According to the BH Presidency’s press release, both sides expressed satisfaction with the successful cooperation of state and FBiH institutions with the ICTY, and reiterated their commitment to continue the cooperation in the upcoming period, especially on issues concerning the establishment of a special department for war crimes with the BiH Court .

Colak comments the meeting in ICTY

Hartmann says Prosecutor not satisfied with the HDZ cooperation on HB archives

 

Nezavisne Novine pg 3 ‘Hartmann: We are not satisfied with the so far cooperation with HDZ’ by M. Cubro Florence Hartmann, Spokesperson of ICTY Chief Prosecutor, on Friday stated that the Hague Prosecutor’s Office is not satisfied with the cooperation it has with the officials of HDZ of BiH, regarding location of the war-time documentation of the former Croat community of Herceg Bosna.

BiH Justice Minister discusses transfer of cases to BiH Courts with ICTY officials

 

Dnevni List Sat pg 5 ‘Trials in The Hague and Sarajevo’ by A. Beus – ICTY Spokesperson Florence Hartmann confirmed that BiH Justice Minister Slobodan Kovac talked with ICTY President Theodor Meron and Chief ICTY Prosecutor Carla del Ponte in The Hague on Friday about preparations for transferring of the ICTY cases on BiH courts. She added that the final decision on the cases that could be transferred on BiH courts have not been passed yet.

RTRS Fri, FTV Fri, BHT 1 Fri – Slobodan Kovac stated on Friday in ICTY that transfer of first cases from ICTY to BiH Courts is expected in first months of 2005. Kovac said that most probably this will include transfer of twelve cases on war crimes and he warned that BiH doesn’t have adequate detention or prison unit.

Dukic said that the visit of ICTY Chief Prosecutor Carla del Ponte is “very likely”, but that the exact date and the protocol of the visit need to be agreed with the Prosecution.

This has been confirmed in the press release issued by the Head of the Special Department of the BH Court for organized and economic crime and corruption John McNair. The bill of indictment accuses all seven of attempting to alter the constitutional set-up, by threatening to use force, and secede part of the territory of the Federation BiH. “These indictments refer to the measures adopted at the so-called Croat People’s Congress, which also includes establishment of the inter-cantonal council as the form of the Croat Self-Rule,” press release reads.  Jelavic, Prce and Curcic are also accused of undermining military capacity. In addition, Jelavic and Prce are also accused of abuse of office or authority, which refers to the call to dismiss the Croat component of the FBiH Army in March 2001.

Colak: ‘Bill of indictment against Jelavic is senseless’

 

Dnevni List Sun pg 7 ‘Croat demands were fully justified’, mentioned on cover, by J. Petrovic – HDZ BiH leader Barisa Colak assessed as unacceptable the processing of political initiatives for equality of Croats in BiH in time when the international community pledges for constitutional reconstruction in the country. “This year when the public discussion on re-organization of BiH is not considered to be heroism and when the High Representative [Paddy Ashdown] stands for reconstruction of the state I believe that it does not make any sense to have such processes unless they have a different background. New constitutional changes are being announced and this can be a certain message,” Colak said and added that the demands of the Croat National Congress were justified having in mind non-democratic moves of the Alliance for Changes and constitutional changes, which brought Croats in a subordinate constitutional and legal position.

DA op-ed praises issuing indictment for Croat Self-Rule

 

Dnevni Avaz Sun pg 3 ‘Indictment as a warning’ op-ed by Almasa Hadzic – Editorial praises the charges pressed regarding the Croat Self-Rule. It reads: “Without intention to prejudice the final decision of the BiH court in this case, it is undisputable fact that in a future of ‘protectors’ of national interest will think well in advance before they start with the establishments of ‘self-rules’ and similar creations damaging the state… As for BiH citizens that want to live in a peace, this is a message that our country has institutions ready to protect them.”

Bosniaks and Serbs clash in Konjevic polje, returnee Fata Orlucevic injured

 

Oslobodjenje Sun pg 3 ‘Group of Serbs beaten returnee Fata Orlovic’, mentioned on cover, by Fena – An incident occurred in Konjevic Polje near Bratunac between groups of Bosniaks and Serbs on Saturday afternoon before planned mass in Serb Orthodox Church, built illegally in the yard of Bosniak returnee Fata Orlovic. The incident took place when a group of group of Serbs who gathered from other villages tried to open the church for a mass, while Fata Orlovic tried to prevent them saying usage of the church was banned by RS inspection. She was consequently arrested, and it was reported that she attained injuries during the arrest and was transferred to Tuzla Clinic. According to Refik Begic, Head of Bratunac municipality, the fight took place after Serbs together with the local priest started to verbally offend Bosniaks.

Dnevni Avaz Sun pg 2 ‘Fata Orlovic attacked in her own yard’ by E.H. – According to returnees, Orlovic was injured when a Serb pushed her and she fell down losing conscience. Doctors in Tuzla Clinic could not confirm how serious was she injured.

FTV Sat FTV reports that about 100 Serb and Bosniak citizens confronted.

Dnevni Avaz Sun pg 2 ‘Fight in front of the church’, mentioned on cover, by E. Huremovic – DA says that on both sides there were dozens of people who throw stones at each other, and that the possibly tragic consequences were prevented “only thanks to the effort of about 50 police officers from Bratunac.” According to the Chief of Public Security Centre Bijeljina, Dragan Peric, the incident occurred because group of Bosniaks prevented the mass to be served in the church. However, Avaz says that Bosniak returnees claim that it happened when a local priest hit one Bosniak. Police in Bratunac confirmed that the mass was supposed to be served by controversial bishop Vasilije Kacavenda.

RTRS, VL features on allegations of terrorists’ presence in BiH

 

RTRS Sat by Dragana Knezevic – RTRS comments that every time there is a terrorist attack in the world some kind of connection is made to BIH, however so far BiH has not been considered as a country directly connected to terrorism. “The relation towards BIH is still fair. All press headlines, things that appear from time to time have to have a firm argument that they are not true. Only with firm argumentation that image can be removed”, says Mladen Ivanic BiH Foreign Affairs Minister. Research of war past is necessary since it enabled certain individuals to come to BIH, obtain the passport and open various humanitarian organizations in FBIH. “We have our problems due to individuals and certain organizations,… especially certain humanitarian organizations”, says Dragan Mektic, Deputy BiH Security Minister. Reporter concludes that the fact is that when it comes to investigating this problem, political will in FBIH is necessary in order to answer all questions related to terrorism in BIH.

Vecernji List Sat front pg ‘Terrorism from BiH threatens Europe’, pg 5 ‘Biggest danger of terrorism to Europe threatens from BiH’ by M. Vasilj carries an interview with expert for anti-terrorism Darko Trifunovic. Among the other things, Trifunovic says, that none can claim that there are no Al-Qa’id camps in BiH. According to Trifunovic they are located in villages and settlements where Islamic fanatics come with the help of radical circles from BiH. I. – Former RS Prime Minister and President of SNSD, Milorad Dodik, said at a press conference on Friday that the criminal charges against him have been intentionally raised during the election campaign and that for the last four years the RS Ministry of Interior, instigated by parties in power, has been doing the same before every single elections. Dodik said that charges have been filed against him two days ago over suspicion that he approved the transfer of 700.000 KM to the Nova Banjalucka Banka in 1998 without the consent of the RS Government as a guarantee for a company from Laktasi for the import of cigarettes, which he denied.

BiH Association of unemployed holds protests in 13 cities

Kavaz-Sirucic – The BiH Association of the unemployed on Friday held protests in 13 BiH cities warning the authorities of the unemployment issue in the country. “We call upon BiH authorities and all political parties to finally pay attention to half a million of unemployed people and to ensure working places, good quality social protection and to finalize privatisation,” Jasminka Mujkic, Association’s secretary-general stated at the protest held in Sarajevo .

FTV Fri – According to FTV, local police has tried to prevent protests to be held in Siroki Brijeg.

Health workers in Central Bosnia protest over bad working conditions

Babic – Daily reports on the protests held on Friday of the health workers in Central Bosnia Canton, who demand from the Cantonal government to improve their working conditions. Abud Saric, Vice President of the Independent Trade Union of health workers in FBiH, announces that unless Government of the Central Bosnia finds solution for the workers, Union will discuss possibility of holding a warning strike of all health workers in the territory of FBiH for a longer time frame.

VL interview with ITA Director Kemal Causevic on VAT

Medunjanin – In an interview given to VL, ITA Director Kemal Causevic commenting on the decision of the BiH Parliament to reject ITA and BiH Council of Ministers’ proposal on a single VAT rate says that he is convinced that all this would not have happened after the elections. Asked whether the International Community will exert pressure due to such decision of MPs, Causevic says that he would no call it pressures. He added that probably the talks with IMF will take place but these talks cannot be qualified as pressures but the talks whose goal is to find the best solution. Asked whether such development of events might postpone application of VAT, Causevic says that it might happen.

Malagic – The Chair of the BiH Council of Ministers, Adnan Terzic says he is very satisfied with the outcome of the visit to Russia, where one of the priorities was to discuss the BiH’s debt for gas supplies. On this issue, Terzic said that certain improvements were made in negotiations and believes that their result will be positive. In addition, BiH delegation talked to “Gazprom”, gas supplier, and stressed that they want this company to be BiH’s strategic partner. He said that a number of other economic issues were discussed, such as possibility of goods exchange and establishment of free trade agreement between two countries.

Update to removal of prefix ‘srpski’ from names of cities in RS

 

BHT 1 Fri – At its upcoming session, the BiH Constitutional Court will discuss the implementation of the decision regarding the removal of prefix ‘srpski’ in the names of several cities and municipalities in RS. The Court will not discuss the names passed by RS National Assembly as it did not carry out the Court’s decision in given deadline. RSNA has passed the changed Law on territorial organization, according to which prefix “Srpski” was to be changed with name of the Entity. After that Croat and Bosniak caucuses in the RS Council of Peoples have asked for the protection of vital national interests. “We want to say, in some way, that RS Government and RSNA have to approach this issue a bit more seriously and propose a new text of this Law, which will fulfill and honor the demands of that decision,” Remzija Kadric, Chairman of RS Council of Peoples, comments. BHT 1 comments that for time being RS Government and RSNA stick to their decisions, noting that everything will become clearer after the session of the Council of Peoples in second half of September. “If it happens that one of the Clubs don’t support it… in that case there is a procedure to try to agree on text of the law between joint Commission of RS Council of Peoples and RSNA” said Mirko Stevanovic, General Secretary of RS Council of Peoples. If the Law fails to be agreed, it will be sent to RS Constitutional Court.

EuroBlic RSpg 1 ‘Bosniak’s veto is an obstruction’ by Tijana Veselinovic Miroslav Mikes, Chairperson of RS Council of Peoples said there will be no change in the name of cities with prefix “Serb” until decision is made whether proposed names are in violation of vital national interest of Bosniaks in RS.

BHT 1 Sat – RS President Dragan Cavic commented: “RS is a name from BIH Constitution. It doesn’t represent anything that can dispute the constitutional existence of any people… So, this is a political attempt to get voters, with a big chance of not being successful at the Constitutional Court. It will definitely not succeed this time.”

Dnevni Avaz pg 8 ‘RS respected the order of the BiH Constitutional Court’ – RS Minister of local self-governance, Slaven Pekic, stated in Mrkonjic Grad that the RS authorities did respect the decision of the BiH Constitutional Court with RSNA adopting the Law on changes and amendments to the Law on territorial organization of RS.

New US Ambassador to BiH: US will not leave BiH

 

Dnevni Avaz Sat cover splash, pg 5 ‘There is not chance for America to leave BiH’ not signed – DA writes that BiH Embassy to USA has organized a reception for new US Ambassador to BiH, Douglas McElhaney. At the occasion, Ambassador gave statement to the Voice of America and denied that there is any chance for USA to leave BiH. “BiH and countries around hit more often show themselves as the solution, as good example and not anymore as the problem, and we want to continue our participation in that process. That will be my task as US representative. I intend to put a lot of effort in that together with all our allies and international organization, but especially with people and authorities of BiH,” McElhaney stated.

Cardinal Puljic demands Pope’s protection

 

Vecernji List Sunfront pg ‘Cardinal demands Pope’s protection’, pg 3 ‘Take side of BiH Catholics before world power-wielders’ by D. Jazvic – VL carries a letter sent by Cardinal Vinko Puljic to Pope. Among the other things, the letter says that Catholics are not equal with other citizens in BiH. According to Puljic, such situation is not the result of the war only but the result of the politics and intrigues of power-wielders. Puljic also called on Pope to take a side of BiH Catholics before world power-wielders.

FTV on ‘sex affair’ in BiH state institutions

 

FTV Sat – FTV reports that a female candidate for a position in one of BIH state institutions confirmed rumours regarding the sex affair in BIH state institutions. She sent a letter to FTV confirming she was asked for a sex ‘favour’ during the job interview. FTV says that this confirms accusations earlier made by Nikola Spiric, Deputy Chair of BIH HoR. FTV invites all persons with any information about similar cases to inform them by a letter or through a phone call.

RS Chief Auditor denies audits are politically motivated

 

Nezavisne Novine pgs 4-5 in NN supplement Revija ‘They better be doing their job in accordance with the Law, instead of accusing me’ by Dragan Risojevic – In a two-page interview with NN, Bosko Ceko,RS Chief Auditor, emphasises that the audit report on RS Interior Ministry has nothing to do with politics. He said that the audit in MoI was planned at the beginning of the year and that all facts stated in the report are documented. Ceko added MoI should better concentrate on removing irregularities observed in audit instead of making accusations against him.

RS Government set plan to remove ‘irregularities’ in RS MoI

 

FTV Fri, Nezavisne Novine pg 4 ‘Government worked out plan for order introduction at MoI’ by N.N. Vlado Blagojevic, Secretary at the RS Government, on Friday confirmed that the RS Government has set the plan and programme for removal of irregularities detected in the audit report of RS Interior Ministry. In a statement to Srna, Blagojevic stressed that the plan and programme consists of 22 items, noting this plan will be made to public and media in the near future.

RTRS Fri – Government also has observed certain difficulties in realisation of CIPS project. Measures were determined for more efficient work of the CIPS services.

NN op-ed connects PDP with ‘irregularities’ in RS MoI

BHT 1 feature on audit reports of BiH institutions

 

BHT 1 Fri by Marina Boskovic – Four months after the publishing of audit reports on BiH institutions, no measures were taken against those responsible for embezzlements of millions KM. BiH Audit Office will publish the summary report on the work of 37 BiH institutions and it was established that most of them have embezzled or irregularly spent millions from BiH Budget. “I have no information that any action was taken [based on] any individual report,” Samir Musovic, Deputy BiH Chief Auditor, stated. Those responsible should have been replaced in June when the Audit Report was published, but instead Parliament’s Commission has determined another deadline for their evaluation. “It  was evident two months ago that parliamentary majority realized that we are entering the election period and that it would be best for them to prolong those issues,” said Zlatko Lagumdzija, deputy in BiH House of Representatives. BHT 1 comments that the appointment of BiH Chief Auditor, Milenko Sego from Ljubuski, was done in a record time, while approvals of two deputies, Samir Musovic and Dragan Kulina lasted nine months. BHT 1 says Sego has replaced Ivan Miletic, who resigned due to family issues and in meantime he got an apartment in Mostar from HDZ. As BHTV found out, Miletic recommended that audit report on BiH Presidency shouldn’t be done at all.
