BiH Constitutional Court in session

 

RHB, BH Radio 1 – BiH Constitutional Court will today (Friday) discuss constitutionality of several articles of the FBiH Law on coat of arms and flag of FBiH, RS Law on flag, coat of arms and anthem of RS and RS law on holidays. The issues have been raised by the Bosniak member of BiH Presidency, Sulejman Tihic.

ICTY indictee from Serbia announces surrender

BH Radio 1, RTRS – General Vladimir Lazarevic has decided to voluntarily surrender to the ICTY, following his talks with Serbian Prime Minister Vojislav Kostunica. Lazarevic, indicted by the Hague tribunal for the crimes committed in 1999, said he will go to the Hague by the end of this week.

HR will declare himself on police reform next week

RHB – Spokesman of OHR, Vedran Persic, stated that the High Representative for BiH, Paddy Ashdown, would declare himself about the Police reform next week.

Hadzipasic: Agrokomerc to be prepared for privatisation

BH Radio 1 – FBiH Prime Minister, Ahmet Hadzipasic, said the management of the Agrokomerc company should prepare the documentation for privatisation as soon as possible. Following the meeting with the company’s delegation, Hadzipasic added that the management board will asked to also prepare the report on company’s finances and the production plan, which should contribute to solving the Agrokomerc’s problems.

DRC to hold inaugural session on Jan 31

FENA – Defence Reform Commission will hold an inaugural session on January 31 (Monday) in Sarajevo, in frame of its new mandate for 2005, as NATO HQ Sarajevo announced. HR Paddy Ashdown and NATO HQ Commander General Stephen Schook will present opening remarks at the session.

NGOs criticise the fact Paravac is representing BiH at Day of victory over fascism

 

FTV, Dnevni Avaz pg ‘To ban Borislav Paravac from representing BiH in Moscow’ not signed, Oslobodjenje pg 2 ‘To prevent Paravac from going to Moscow’NGOs (SUBNOAR, Krug 99, VKBI, SGV, HNV, Helsinki Committee, BiH Academy of Science and Culture and “Josip Broz Tito” Union of Associations) have stated that Borislav Paravac should not represent BiH at the ceremonial marking of the day of victory over fascism, which is going to be held on 9th of May, in Moscow. These organizations have asked BiH Presidency member Sulejman Tihic, who claims to be SUBNOR member, why he did not prevent Paravac from representing BiH at the ceremony in Moscow. They say that Paravac is proud of his fascistic ideas. Nongovernmental organizations decided to issue a request to Russian Federation Embassy, asking Russian Government to declare Paravac as unwanted person, due to his fascistic ideology. Chair of BiH Helsinki Committee Srdjan Dizdarevic also criticised the idea of Paravac representing BiH in Moscow. 

SDP Youth criticises attendance of Paravac at the ceremony

BHT1: There is no single day dedicated to war victims in BiH

BHT 1 – BiH have no clear position in condemning crimes committed in the WW II as well as in condemning crimes that happened in the recent war in BiH. BHT pointed out that BiH have no a single day in a year in memoriam to BiH victims of war.“Couldn’t BiH authorities come to their sensesand find one date, at the State level, or several dates, when Governments’ officials and we could gather at many places?”, the President of the RS Association of Former Camp Inmates, Slavko Jovicic, wonders. “Status of POW is not solved and they are left out of the law by the State and society,” stated representative of the BiH Association of Inmates, Osman Gojacic. Unsuccessful attempts of adopting the law on State holidays proves that three is still no political will in BiH to officially mark all dates important to all victims of war in BiH, commented reporter. “I would say that this issue is treated differently from one to another occasion. The only thing that is organized well so far is marking of the Srebrenica Day,” said BiH Minister of Civil Affairs, Safet Halilovic.

RTRS by Sinisa Mihajlovicalso comments that Bukejlovic position is unclear at the moment since he said earlier that SDA will not participate in the new Government and wouldn’t allow any questions to the journalists.

Jusufovic: SBiH top would reach decision on support to new Government

 

Oslobodjenje pg 2 ‘SDA at new RS Government?’ by O. Vukovic, mentioned on cover,inset ‘A stance of SBiH is awaited for’ carries a statement of Munib Jusufovic (SBiH) who announced the party would support all reform processes of future RS Government, regardless of whether it would participate at the executive authority or not. However, he stressed, the party top would reach the final decision on support to future government.

BHT 1, RTRS – After Bulejkovic’s calling on the Agreement, Party for BiH stated that it will not participate in the new RS Government nor it will support it.

Osmanovic: Matijasevic to remain Interior Minister

 

Dnevni Avaz pg 4 ‘Matijasevic will be Interior Ministry in the new Government’ by E.S. – Commenting on the meeting held with Pero Bukejlovic on Thursday, RS Vice President, Adil Osmanovic, said: “I said to him it was not politically wise for him to state that there will be no place for SDA in the new Government, and he responded that we, as politicians, must understand such sort of statements, because they like to hear it in public.” Bukejlovic promised to the SDA that even if its ministers will not be a part of the new Government, this will not have negative impact to the return process. “I also understood from our talks that Darko Matijasevic… will remain on the position of the Interior Minister,” added Osmanovic.   

Reactions of RS politicians on possible participation of SDA at RS Government

 

Nezavisne Novine cover and pg 4 ‘SDS enabled SDA participation in the new government of RS’ by V. Popovic Milanko Mihajlica, President of SRS, stated that SRS would not support the Government with SDA officials in it. Ognjen Tadic, advisor to RS President and Secretary General of “Dr. Vojislav Seselj”, on Thursday said he was not informed of this, adding that information on whether SDA would participate in RS Government should be checked up. Marko Pavic, DNS President stated DNS remained faithful to Agreement on political principles, adding that DNS is not interested in what SDS and SDA have possibly agreed. Rajko Todorcevic, President of Centre Club at RS NA, stated that four delegates making this Club would not support Government with SDA. Unlike other parties, SNSD is not surprised with the latest development. Krstan Simic, SNSD Vice President, stated that “agreement between SDS and SDA has verified honesty of the intention that new Government should be elected in RTS”.

Nezavisne Novine op-ed pg 7 ‘Cavic’s slalom’ by Dragan Risojevic – The author is extremely critical of Pero Bukejlovic and Dragan Cavic, regarding the latest information on the SDA participation in the new RS Government, noting that Bukejlovicmay now breath freely knowing he may have collected sufficient support for his cabinet. Regarding Cavic, the author first refers to some provisions of the Agreement on political principles (which accused SDA of supporting the concept undermining the existence of RS) and then claims, referring to some unofficial information, that he meets the interests of HR. He notes HR Ashdown may be acting as their godfather.

EU Heads of Missions concerned over only one held session of CoM since December

Pasic – The Heads of Missions of the European Union in Sarajevo are concerned over the work of the BiH CoM, which held only one session since the beginning of December. The Heads of Mission are confident that all members of the Council of Ministers, including those who have tendered their resignation without it having been accepted, are aware of their responsibilities. It depends on the agreement between SDS and PDP leaders will their ministers in resignation attend the CoM’s session scheduled for the February 1.

BHT1: Participation of Serb Ministers at 1 Feb CoM session still uncertain

 

BHT 1 by Gvozden Sarac – “I still didn’t receive invitation to the session, I didn’t get the agenda. It was reported in media that the session will be held on February 1,” said BiH Minister of Transport and Communications, Branko Dokic. BiH Defence Minister, Nikola Radovanovic, expressed his reserves about coming to the session. “Ministers and Deputy Ministers from SDS won’t attend the session if ministers from PDP don’t attend it,” stated SDS Vice-President,Bosko Siljegovic. “If PDP wants to survive, it has to disassociate from SDS and it has to stop calculations with SDS. Their ministers shouldn’t return to CoM, they should stick to their position of demanding new CoM structure,” said “Nezavisne Novine” Editor-In-Chief, Dragan Jerinic. As BHT founds out, PDP will most likely suggest to its ministers to attend CoM’s session.

Mektic: Nobody invited me to session of BiH CoM on Feb 1

 

Dnevni List, pg 6 ‘There is crisis in Council of Ministers’, by De. L. – Deputy Minister of Security of BiH, Dragan Mektic, claims there is a crisis in the functioning of the BiH Council of Ministers, adding that nobody invited him to the session of the BiH CoM, scheduled for February 1. “Nobody informed me or invited me to the session, neither the High Representative for BiH, Paddy Ashdown, or Chairman of BiH CoM, Adnan Terzic, and I think it (session) will not be held before the RS Government has been formed”.

BHT1 also reports Mektic was not invited to the session.

Colak confirmed that the first CoM session in 2005 will be held on 1st of February.

Terzic: CoM can continue to be reformatory engine

 

Dnevni Avaz pg 5 ‘Single condition for restructuring is to establish the Ministries for Agriculture and Employment’, mentioned on cover ‘We still can be reformatory engine’, by Sead Numanovic – The Chair of the BiH Council of Ministers, Adnan Terzic, states in the interview to DA that he is ready to talk about possibility for restructuring the state government, as recently proposed by Mladen Ivanic, adding that the condition is to carry out changes of the Ministries. “If we are launching the restructuring, my condition is to discuss the establishment of the Ministry for Agriculture and Energy, and the body for health and social issues, and employment,” said Terzic. Asked to explain his stance that all those ministers who fail to appear on the 1 February CoM session will be relived of duty, Terzic says that it is not true, as stated by some, that he was humiliating Serb ministers with this announcement: “I still believe that this CoM that continue to be reformatory engine in BiH.”  He added that he is very satisfied with each minister and would not change a single one, including Ivanic. Ambassador Cliff supports Cavic’s call

 

Nezavisne Novine pg 4 ‘Cliff welcomed Cavic’s call’ by V.P.; Glas Srpske pg 2 ‘Ministers to resume their work’ by SRNA, Dnevni Avaz pg 4 ‘Cliff: Political manoeuvres brought reforms in jeopardy’ By Srna – Embassy of Great Britain to BiH on Thursday issued a press statement saying that the Ambassador Ian Cliff has welcomed the call of RS President Dragan Cavic to RS and BiH politicians to give their contribution in order to enable proper functioning of institutions at state and entity levels. Ambassador Cliff warned political manoeuvres brought basic goals, such as economic reforms, launching of stabilisation and accession negotiations and membership at PfP, in jeopardy and he said these goals cannot be achieved without a functional Council of Ministers.

SB analyses PDP’s role in current political developments

 

Slobodna Bosna pgs 26-28 ‘Ivanic’s tactics without a strategy’ by Danka Savic – SB’s article analyses the current situation in the RS and BiH authorities, noting that in light of upcoming session of the Peace Implementation Council on 3 February, OHR applies pressure on Serb ministers to attend the scheduled CoM session. Author comments that the chances to overcome the current “political agony in both entity and state levels” are small, since there is no will for something like that. “The key role in creating the crisis in BiH CoM and other state institutions is played by the PDP ministers, lead by Mladen Ivanic, who obviously wants to keep CoM a hostage.” Article further argues that since the sanctions against PDP and SDS, Ivanic – now ‘blackmailing’ SDS regarding the support for Pero Bukejlovic – has openly called on the blockade of state authorities, which is not in the interests of SDS as it is obvious that it would be blamed for the breaches of Dayton agreement. Also, in case of withdrawal of the Serb Ministers, CoM would not lose the political legitimacy towards the international community, and according to the law, in this case CoM could not hold session but all of its Ministries would continue to work as every Minister has a deputy from other peoples. Currently, SB says Ivanic is trying to go back to CoM. “Unless the crisis in RS is solved some time soon, that could eventually lead to extraordinary elections,… also mentioned recently by Douglas McElhaney… [However] it is to be expected that OHR will succeed to make Serb ministers to attend the CoM session, … despite the fact that the exit from either BiH or RS crisis is not even close.”

Pecanac and Markovic: we have to restore trust in SDP

 

Dnevni Avaz cover splash, pg 3 ‘We have to restore the trust in SDP’ by M. Kukan – DA article refers to the upcoming presidential elections within the SDPA, and the beginning of the campaign for two candidates – Nermin Pecanac and Ljubisa Markovic. In an interview with DA, Pecanac and Markovic did not want to comment speculations that their chances to win over Zlatko Lagumdzija are null, but they have stressed it is a privilege to be nominated. Markovic says that his aim is to stop the trend of downfall of SDP voters: “I want to help restoring the trust into SDP as the party which wants to build BiH… in interests of all citizens, not only of the small circle of people which have direct benefit from it. [I want] to move all our members to fight apathy which took over SDP.”

HDZ and SDA representatives held a meeting

 

Dnevni Avaz pg 2 ‘New Constitution by the next elections’ by A.M. – The representatives of the HDZ and SDA held meeting in Sarajevo on Thursday to discuss the current political situation, focusing at the constitutional changes, the crisis in CoM, defense and police reforms. SDA leader, Sulejman Tihic, explained for DA that this was the first in a series of upcoming bilateral meetings: “The idea is to hold… a joint meeting and try to give an answer to the issues… The talks will be conducted with all parties, meaning those from RS also. The joint meeting of all parties should be held by 10 February.” Tihic adds that SDA and HDZ have similar attitude on some of the issues, such as the BiH Constitution being the ‘crisis generator’. Tihic adds that constitutional changes should be finalized this year and certainly before elections in 2006. Party for BiH has also met with HDZ delegation, consisting of Barisa Colak, Dragan Covic and Niko Lozancic.

Nezavisne Novine op-ed pg 7 ‘Where does RS head to?’ by Slavo Kukic Kukic is critical of the authority in BiH and RS, claiming that BiH officials could, with no doubt, be used as textbook examples of the state, where political elites are unserious and superficial. He is further critical of Mladen Ivanic and his political games, as well as of Milanko Mihajlica and Pero Bukejlovic. The author refers to the most recent statement of Mihajlicawhen he said that the situation we are currently living in is of temporary character, because anything may happen when the international troops leave, he noted. On this, Kukic stresses that Bukejlovicshares the view of the radicals, bearing in mind they would support his Cabinet.

Salkic: RS Constitutional Court cannot postpone payout of war compensation

 

Dnevni Avaz pg 12 ‘Not even RS Constitutional Court can postpone payout of war compensation’ by A. MalagicRamiz Salkic, the head of the Bosniak Caucus in the RS Council of Peoples, said that the Caucus will not withdraw the request for launching the issue of vital national interests regarding the law on postponing the payout of the war compensation. Salkic further comments that this initiative, started by Milorad Dodik at the latest session of the RSNA after the bank accounts of Trebinje and Vlasenica municipalities were blocked, was absurd: “We cannot now say that judicial verdict are not valid anymore because someone cannot pay for what was robbed during the war in BiH… the procedure on the issue of vital national interest is before the RS Constitutional Court. Even if it concludes that the vital national interest was not breached, the Constitutional Court cannot postpone the earlier verdicts [on compensations].”

DL: McNair meets with Financial Police in Mostar, takes documents related to Hercegovacka bank case

 

Dnevni List, front pg splash and pg 2 ‘Prosecutor McNair visits Financial Police in Mostar’, by Nevres Dedic – Reports that the head of BiH Prosecution’s Department for organized crime and corruption, John McNair, was in Mostar Thursday. DL unofficially learns that McNair had a meeting with the chief of Financial Police in Mostar. Moreover, DL learns from sources close to Police and BiH Prosecution that during the meeting, McNair took over several documents that could affect the future course of trials to Ante Jelavic in the ‘Hercegovacka bank’ case.

VL: SIPA confiscates documents of BiH Football Association, alleged abuse of Association’s money

 

Vecernji List, front pg splash and pg 3 ‘SIPA combing through football’, by Dalibor Ravic – Reports that SIPA’s inspectors confiscated a lot of documentation of the BiH Football Association (BiH FA) in an attempt to reveal how the BiH FA’s money went missing and which was allegedly used to build houses to senior officials of the FA. The main suspects in this case are the Secretary General of the FA, Munib Usanovic, Director of BiH national squads, Ahmet Pasalic, and the FA’s treasurer, Miodrag Kures. They allegedly also had deals with Muhamed Ali Gasi, a suspected member of the Sarajevo underground.

Kalamujic, mentioned on cover, Euro Blic RSpg 5 ‘Protest because of “Algerians”’ by BETA; Glas Srpske pg 4 ‘Torture in Guantanamo’ – Nadja Dizdarevic, the wife of a member of the Algerian group, addressed a public call for a peaceful protest gathering of citizens in front of the BiH Parliamentary Assembly building on Monday, January 31. Her husband is detained at the U.S. Army’s military base Guantanamo in Cuba for three years. Dizdarevic requests from BiH Minister of Justice Slobodan Kovac to inform the public about the report on visiting Guantanamo , which will confirm torturing and violating of human rights of BiH citizens.

VeleRegarding investigations on custom frauds and bribery, “Lijanovic” company Slavo Ivankovic Lijanovic was interrogated Thursday at BiH Prosecution. He denied all allegations of the investigation on embezzlement in his company. Other Lijanovic family members will also be interrogated. BiH Presidency member Dragan Covic and BiH Constitutional Court Chair Mato Tadic are also the accused ones in this case.

Mektic: citizenships were granted without identity checks

 

Nezavisne Novine pg 5 ‘Citizenship granted without identity checks’ by M. Cubro – Dragan Mektic, the Deputy BIH Minister of Security, claims that persons suspected of terrorist activities had been granted the citizenship of BiH without any previous checking of their identity. According to Mektic some citizenships used to be granted to persons who had never been in BiH and had never visited it after becoming its citizens. Robert Cvrtak, the Spokesperson for the Federation MoI, said that criminal reports had been filed against 15 officials of the state and Federation institutions that are suspected of having violated the Law by granting citizenship to persons that do not meet the prescribed requirements.

CUbro – According to NN, TWRA, a humanitarian organisation from Vienna, the business activities of which were investigated by the Austrian police, paid DM 600,000 to set up the Foundation for supporting Muslims in BiH in 1996. The President of its Steering Board, since its establishment has been Hasan Cengic.  This Foundation is the owner and founder of companies from the BIO group.  The activities of the TWRA are being investigated by the BiH Prosecutor’s Office, too, and the Federation MoI recently searched their premises in Bihac. The TWRA is represented by Dr Fatif el Hasaneien.

OSCE presented the report on implementation of the law on criminal proceedings in courts in BiH

Zekic – The OSCE Mission to BiH presented on Thursday in Mostar a report on implementation of the new law on criminal proceeding in courts in BiH. The report will be used by courts and institutions for assessment of court practice, namely for improvement of efficiency and impartiality of implementation of the criminal proceeding. The report also points out that there are fields to which more attention should be paid and that domestic institutions should assess implementation of laws, propose amendments and addenda, organize professional training and influence administrative organizing of courts.

Unusual theft in Trebinje

ITA employes 549 Bosniaks, 501 Serbs and 324 Croats. ITA reminded that they work successfully for a month and already register income increase comparing to same period last year.

RS pensioners complain

 

Glas Srpske cover page story ‘Earnings on basis of somebody else’s misery’ by R.S. GS carries complaint of the RS Pensioners’ Association regarding the pension increase in F BiH for 4.5%. The Association is also critical of the F BiH authorities, that are persistently ignoring the implementation of Human Rights Chamber on payment of pension by the entity they were earned. It claims the average pensions in entities now differ for 30%. They note they have addressed HR several times, demanding a meeting with HR Ashdown, but they have never received a single response to this. They note they would address a letter to Kofi Annan, UN Secretary General, informing him of brutal violations of basic rights and freedoms.

Milanovic: RS will construct “Buk Bijela” power plant

Allegedly, the RS Army had recruited, among others, a former security officer of the BiH Army for the area of eastern Bosnia and the current Police Commissioner of the Sarajevo Canton, Himzo Selimovic, who was allegedly commended by Ratko Mladic.

Serbian Minister of Justice Davinic: we are not protecting Mladic

Glas Srpske pg 2 ‘We are not protecting Mladic’ by AFP – The SCG Minister of Justice, Prvoslav Davinic, on Thursday expressed his regret over the fact that the international community was conditioning its cooperation with Serbia with the arrest of Ratko Mladic, a Hague fugitive. According to Davinic, this is very frustrating and represents a bad approach. He claims that no active officer of the SCG Army was offering support for any war crime suspect, adding: “We are checking military installations and military personnel to establish whether such support could be offered.”
