High Representative Extends State Property Disposal Prohibition

The High Representative, Miroslav Lajčák, today issued a Decision extending the State and Entity laws that temporarily prohibit disposals of state property until 30 June 2008. Although this is the fifth extension of the temporary ban, the Chairman of the Council of Ministers asked the High Representative to allow for additional time for the State, Entities, and the District of Brcko to reach an inter-governmental agreement and to enact appropriate legislation. Accompanying today’s extension, the High Representative in a letter urged the political leaders in a to take this last opportunity to bring this issue to a sustainable conclusion by finalizing an intergovernmental agreement before March 2008 and to enact appropriate laws before the Decision expires. 

The High Representative also underlined that both the Intergovernmental Agreement on the principles for allocating State Property ownership, and the legislation that will be based on the agreement, must be guided by a functionality principle whereby each level of government in Bosnia and Herzegovina owns the assets necessary to fulfill their respective competencies under the Constitution.
