Draft Law on Notaries Presented in Brcko

The GTZ project team on Economic Law Reform, in cooperation with the OHR Brcko Legal Section, today presented the Draft Law on Notaries of the Brcko District to members of the Brcko District Judiciary, councilors, and private and government lawyers, at OHR Brcko.

The law, drafted by BiH experts under the chairmanship of an international expert, defines the role of public notaries. It has recently been adopted in the Federation. The RS Government will shortly consider a compatible RS Notaries Law.

Notaries contribute to legal security by providing reliable documentation of important legal transactions, and they act as a safeguard against undue haste in concluding contracts. The Notary, as a public office holder, is obliged to act impartially when determining the will of the parties. The Notary must inform the parties about the consequences of their proposed course of action before drawing up the difinitive text of a contract. In this way legal disputes can be avoided from the outset. The notarised document is a public document which is easily and economically enforceable.

A member of the GTZ project team, Mr. Enes Bikic said it would contribute to a secure legal framework for legal transactions, in the tradition of European law and best European practice.
