Deadline for Claims under the RS Labour Law’s Article 152 is February 16, 2001

The Office of the High Representative, OSCE, UNHCR, and UNHCHR wish to inform individuals that the deadline for submitting claims for illegal dismissal under the RS Labour Law is February 16th, 2001. Those people who believe they were illegally dismissed from their jobs between 31 December 1991 and 16 November 2000 must submit a claim to the Ministry for Veterans, War Victims and Labour in Banja Luka before this date to be able to claim compensation.

Article 152 of the RS Labour Law specifies that to be valid, claims must be made within 90 days of the law entering into force, that is no later than February 16, 2000. The former employee’s claim should be sent by registered mail to the Ministry for Veterans, War Victims and Labour located on Vuka Karadzica 4, Banja Luka, and marked for the attention of the Commission for the Implementation of Article 152. Claims only need to contain the complaint in writing but photocopies of relevant documentation can also be submitted if available.

The Commission will review the claims and can listen to evidence from the former employee and the employer, call witnesses and experts, and has access to all relevant information and documentation held by the competent authorities and the companies concerned. Where individuals have started civil proceedings before a court, the court will transfer all cases to the Commission.

The OHR, OSCE, UNHCR and UNHCHR encourage all individuals concerned to file their claim as soon as possible, and in any case no later than February 16th, 2001 to ensure that their case is heard.
