Brcko Supervisor Harmonises the Brcko District Law on Conflict of Interest and Election Law with State Legilsation, and Reorganises the Office of the Brcko District Coordinator in the Council of Ministers of Bosnia and Herzegovina

Brcko Supervisor Dr Raffi Gregorian today issued Supervisory Orders enacting the Law on Conflict of Interest in the Institutions of Brcko District, and Amendments to the Election Law of Brcko District. In a second Supervisory Order, he enacted amendments to the Law on Public Administration of Brcko District that reorganizes the Office of the Coordinator for Brcko District in the Council of Ministers of Bosnia and Herzegovina.

In July this year, the BiH Parliamentary Assembly adopted amendments to the Law on Conflict of Interest in Governmental Institutions of Bosnia and Herzegovina. The Brcko District Government and Assembly have not yet harmonized District legislation with the State law. The provisions of this law have bearing on the newly elected officials and executive office holders, and should therefore be known to them once the Central Election Commission announces the final election results.

In this context, it became also necessary to further harmonise the Election Law of Brcko District with the Election Law of Bosnia and Herzegovina in order to avoid any misinterpretation of competencies between the Central Election Commission and the Brcko District Election Commission. .

Thirdly, experiences gained in the functioning of the Office of the Brcko District Coordinator within the Council of Ministers over the last two years suggest that the Office would benefit from some adjustments to its structure and terms of reference, and more effectively manage its mandate of representing the Brcko District’s interests before the institutions of Bosnia and Herzegovina. This requires a technical amendment to the District Law on Public Administration.

Since the regular mandate of the previous District Assembly has expired, and the new Assembly is not yet established, there is no time for the Assembly to adopt the amendments in regular procedure. Therefore, the Supervisor, having consulted with all representatives of political parties in Brcko and with the Central Election Commission of Bosnia and Herzegovina, decided to enact them by way of a Supervisory Order.
