BiH Parliament holds plenary session on economy

 

 

BH Radio 1 By Mustafa Karahmet –The delegates of the BiH House of Representatives and BiH House of Peoples have commenced the plenary session this morning with a focus at the economic issues. They will discuss the draft of the social program aimed at reducing the consequences of the VAT introduction. They are also expected to consider the first annual report covering period from August 2003 to March 2005 on implementation of the BiH Mid-Term Development Strategy, according to which 399 out of 597 planned measures are being implemented. BIH Prime Minister, Adnan Terzic, requested from the Parliament to postpone the discussion on temporal suspension of Free Trade Agreements with Croatia and SCG, as the documents are not yet ready.

BH Radio 1 By Brana Markovic – RS National Assembly started the regular session this morning. The agenda includes the discussion on the draft law on war compensation, report on the RS Budget’s execution for 2004, information on RS internal debt and changes to the law on 0pension and disability insurance. The most disputable is the law on war compensation, strongly opposed by SDA who believes that the law is unconstitutional. Under the law, pay out of the war compensation to war invalids, families of killed and missing persons, and prisoners of war would be limited to period of 40 years, with payments made in securities and without any interest.

CoM in session today

RHB – The BiH CoM to hold a session today. Among the other things, they would discuss the report on execution of the BiH institutions’ budget for 2004.

Olli Rehn on enlargement and Western Balkans

 

BH Radio 1 – European Union will continue the enlargements and the recent failure of its Summit will not be an obstacle to the realization of the European perspective promised to the Western Balkans countries, stated the EU Enlargement Commission Olli Rehn addressing the international conference on the Western Balkans in Brussels.

RHB – Croatian President Stjepan Mesic received the delegation of the Associations of BiH Croats who demanded from Mesic to use his authority in order to improve the position of BiH Croats. They also warned that the IC in BiH has double standards at the cost of the Croat people. Mesic promised that in a proper way he would make topical the issue of the status of the Croat people in BiH and stand for achieving constituency of the Croat people in BiH.

Inset ‘Who was an observer’ – Spokesperson of Banja Luka PSC Rade Mutic has stated EUFOR Wednesday informed the police of the “Harvest” action in Trn and they asked for a presence of Banja Luka PSC members. ‘Policemen were there as observers and they have undertaken no measures’, Mutic said. RHB – EUFOR Spokesperson Robbie Baillie stated that the soldiers found a small amount of weapons during the search. PINK – No one was arrested during the action. “After we collect information, we will act and destroy the nets. EUFOR and NATO will support local authorities in any actions they are intending to carry out, which are directed towards destroying all war crime indictees nets. Such operations are necessary so to preserve safety in the state”, said Baillie.

Cengic expressed his satisfaction adding the Court’s verdict proves the process was politically orchestrated. “Unfortunately, we still have unprofessional police, which attempts to, thorough orchestrated documents, prosecute those that are not suitable to certain political structures,” said Cengic. The travel documents, confiscated at the beginning of the trial, will be returned to Cengic. Reporter commented that this is the third acquitting verdict issued by the Court of BiH in past month.

D. – At the continuation of the proceeding in the ‘Lijanovici’ case, the prosecution has been obliged in the next 15 days: to provide the Trial Chamber of the BiH Court and defense attorneys with a summary of reviewed evidence material seized during the inspection of the Lijanovici business complex in Siroki Brijeg; to state whether there is any material they intended to lean on in the future procedure; to inform the Court and defense whether they intend to change the indictment or whether there will be any additional indictments. Chair of the Trial Chamber, Paul Garlic,made this statement on Wednesday at the debate before the Court of BiH. Defence attorney Marko Martinovic requested from the Court to order the prosecutors to conclude the investigation, because the indictment has already been confirmed and it is unclear how come two days before beginning of trial, the relevant bodies are taking action to seize enormous financial documentation, whose reviewing would take several months.He also requested a decisive interpretation on whether the seized documentation would be used as evidence in this process, because the trial cannot begin until defense have been provided will all documents the prosecutor intends to use as evidence. Prosecutor Jonathan Ratel says the document that were seized during the recent inspection are related to regular financial operations of the ‘Lijanovici’, saying he would be surprised if he found something new in the documents. He noted that he would provide the BiH Court with any new document. Both Oslobodjenje and Dnevni List carry insets reporting that the BiH Court has rejected a proposal of the BiH Prosecution that employees of ‘Lijanovici’, namely Zdenka and Ljubo Simunovic, who got arrested the other day, be kept in a one-month detention.

Danas: More arrests in Herzegovina?

 

Danas, front pg splash and pgs 12-15 ‘Arrests of thirty tycoons being prepared’, by Zdenko Jurilj – Danas learns from an anonymous senior source from the FBIH Interior Ministry that the FBIH MoI SWAT unit could arrest, upon order of the BiH Court, any of the indictees from the ‘Lijanovici’ case (Covic and others) if there is an assessment that the indictees could be affecting witnesses. On top of this, Danas learns that the Special department for organized and economic crime has started procedures against some 30 Croat companies from Herzegovina and central Bosnia , which are charged with various illegalities, such as tax evasions, customs frauds and money laundry. Apparently, in fear of ending up like the ‘Lijanovici’ (sudden raids), owners of these companies asked for the help from the OHR and Croat officials. Danas goes on to say that the whole story has an unavoidable political connotation to it, since majority of owners of the companies under investigation believe it is all part of bigger scheme by which leaders of SDA and SBiH want to dominate the ‘Croat’ areas.

BHT 1 examines the role of international law practitioners in BiH judiciary

 

BHT 1 by Suzana Stambol –BHT report looks into the cases, stating that a number of legal experts believe that the reason for large number of acquitting verdicts are large differences between BiH judiciary system and systems of the international prosecutor’s country. BHT also carries that a number of experts speculate on large level of intolerance between US prosecutors and European justices. Reporter stated that the Special department for organized and economy crime and corruption within BiH Prosecution, lead by the international prosecutors, have lost its second case. After BiH Interpol Deputy Director, Asim Fazlic, was acquitted of charges, the Court of BiH acquitted on Wednesday of charges BiH House of Peoples’ delegate Hasan Cengic. “It is not realistic to expect, in conditions of any judiciary system, that indictments will be successful in every case that we process,” said Prosecutor John McNair.

Domestic judges, lawyers doubt in quality of work of foreign prosecutors

 

Oslobodjenje pg 7 ‘Foreign prosecutors ‘do not have a clue’ ‘ by L. Sofradzija – Osl. says that after charges against former FBiH Deputy Defence Minister Hasan Cengic and former Deputy Director of the BiH Interpol Asim Fazlic were not proved, BiH lawyers, judges etc. who agreed to comment on the work of the Special Department for organized crime, economic crime and corruption with the BiH Prosecution unofficially expressed reserve towards the way in which foreign prosecutors do their job. Spokesperson of the Sarajevo Cantonal Prosecution Oleg Cavka stated that state prosecutors have their support and that the results of the judicial reform cannot be achieved over night. Osl. says that those on whose behalf Cavka gave the aforementioned statement told this daily that they are very skeptical about the way in which foreign prosecutors do their job and some of them even stated that foreign prosecutors do not have a clue.

Dnevni List, pg 2 ‘Prosecutors as buffoons’, by Erna Mackic – Commenting on the raid of ‘Lijanovici’ company and apartments of Zdenka and Ljubo Simunovic, the author argues that prosecutor Jonathan Ratel ordered the operation because he does not have evidence to support the current indictment against Covic and others, which is evident in the fact that the Simunovics got released from detention because they would have been kept in, had the prosecution found new, incriminating evidence. Finally, the author says that the prosecutors, by preparing extensive indictments many parts of which they usually drop, are making clowns of themselves.

New leader of Al-Q’Aida in Saudi Arabia is BiH citizen

Muminovic – Saudi Arabia MoI published a new list of 36 most wanted militants suspected of numerous attacks in Saudi Arabia and other countries. According to anonymous source, the most dangerous terrorist is 36-years old Junuz Muhamed Ibrahim Al-Hajari, who was trained in BiH, married with a woman from BiH, has BiH passport and, according to some assessments, is a new leader of Al-Q’Aida in Saudi Arabia . A source from BiH Ministry of Civil Affairs Wednesday confirmed Al-Hajari is a BiH citizen.

Dnevni List, pg 2 ‘Croats reject law on public RTV system’, mentioned on front ‘Croat Caucus invokes vital national interest’, by Mensud Zorlak – The Croat Caucus in the BiH House of Peoples has invoked the vital national interest clause, thus preventing the adoption of Proposal of law of Public Broadcasting system of BiH. DL says that as one could have predicted this before the session even took place, since the Croat Caucus expressed dissatisfaction with the principles of the law. The issue now rests with the BiH Constitutional Court. Only Tomislav Limov from SDP opposed the procedure and supported the draft law.  BHT 1 – Croat Caucus decided to take this step after none of the amendments to the law that they’d proposed was accepted by the HoP. Those amendments proposedthe existence of three channels in languages of constituent peoples in BiH or establishment of another broadcasting service in FBiH. Croat Caucus Chairman, Ante Spajic, says there are many arguments on their side, including European conventions and BiH Constitution. “I believe that the Constitutional Court will issue positive decision,” he said. This is the second law on PBS system that didn’t get parliamentary support. According to BiH Ministry of Transport and Communications, this draft law guarantees equality to all peoples. “I can guarantee that this draft law is prepared in accordance with European conventions and all international regulations in defining public PBS system,” said the BiH Deputy Communications Minister, Haris Basic. BiH CoM claims that the Constitutional Court will adopt its decision on this issue shortly, and that will ensure adoption of RTV system law by November, when BiH authorities believes that negotiations on Stabilisation and Association Agreement with the EU will begin. Terzic address BiH HoR on crisis in CoM; Lagumdzija walks out of HoR session

Terzic ascertained that in line with the legal opinion of the OHR, a minister whose resignation is accepted performs this duty in technical mandate until a new minister has been appointed, and stressed that the new session of the CoM is scheduled for June 30 [to be also participated by Mladen Ivanic]. After a long debate, the HoR accepted Terzic’s report, but decided to stick by its conclusion from the last session that requests Terzic to continue working to resolve the crisis. Zivak – Article reads that after his address to the BiH House of Representatives on the crisis in the CoM, the Chair of the BiH Council of Ministers, Adnan Terzic, “admitted” to journalists that “ruling parties never had clear political harmonized political direction of acting.” Oslobodjenje says that Terzic was very frustrated with the proposal by the opposition, and supported by the parliamentary majority, to call on him to address the HoR and explain the situation in the CoM as it opens possibility for opposition to point out at him as being the biggest problem in the state. “Instead of having parliamentary majority being behind me and pushing me forward as the Chair, until it was me behind and pushing the parliamentary majority. I am sorry to see representatives wasting their time and money of citizens to talk about things that are not even remotely important as discussion on the police reform or the legislation on public broadcasting system,” stated Terzic.

Sarac – DA learns that Chairman of the BiH Presidency Adnan Terzic was harshly criticized at the SDA Presidency session which took place 2 days ago especially by Sefik Dzaferovic, Adil Osmanovic and Bakir Izetbegovic. The internal conclusion was made according to which SDA members who perform duties in the legislative and executive authorities must consult within the SDA Presidency for all their future moves and stands. DA says that the cause for such conclusion was Terzic’s statement about early elections and the decision on resignation of BiH Foreign Minister Mladen Ivanic. RTRS – Office of the EU High Representative Javier Solana, commented to the statement by SCG Foreign Minister Vuk Draskovic linking Kosovo and RS status, by stating that “the status of Kosovo is an open issue that has to be resolved through a political process, in which the Kosovars, Belgrade and the international Community all have to play an important role.”

Danas, pgs 22-24 ‘RS Government against re-organization of BiH into five regions’, mentioned on front ‘EU wants re-organization of BiH into five regions’, by Team of Danas’ journalists – According to the article, the official Brussels will in the future insist on administrative-political reorganization of BiH in five regions, and will do everything, including exerting pressure, to see the plan through. Apparently, the plan is already known to BiH authorities. Danas says that unlike majority of ruling and opposition parties in the FBiH, which pretty much agree to the concept of regionalization, parties from the RS oppose to such plans, as evident in the letter that RS Government sent to the European Commission in BiH. The letter says the plan to organize regions within BiH does not reflect needs of the RS and as such is totally unacceptable to the RS.

BHT 1 – The BiH House of representatives failed on Wednesday to adopt two proposal for Srebrenica resolutions, initiated by delegates Elmir Jahic from SDA and Muhamed Morangic from BOSS. Serb delegates voted against resolution and requested those texts to be send to the Commission that would harmonize them in a acceptable to all BiH Parliament delegates, reports BHT. Jahic said that resolution does not contain anything that was not confirmed clearly by the judiciary bodies, the ICTY at first place, “and that is that genocide happened in Srebrenica and that responsible persons must be brought before justice,” he said. SDS delegate Momcilo Novakovic says the problem is that proposed resolution means calling the institutions to take responsibility for what happen in Srebrenica “what practically lead to something against which we are fighting all the time and that is abolishment of the institutions and creation of collective responsibility for events in Srebrenica, what is absolutely unacceptable.” Member of the Association of mothers of Srebrenica and Zepa enclaves, Sabaheta Fejzic, is not how much such resolution is necessary at all, because the genocide in Srebrenica is confirmed by the ICTY. Preparations for Srebrenica commemoration: over 50.000 people expected to attend

 

Hayat, Oslobodjenje pg 6 ‘Another 570 victims to be buried in Potocari’, mentioned on cover, by Sanita Rozajac – The organization board on preparation for Srebrenica commemoration ceremony to mark the 10th anniversary of the massacre held a session on Wednesday and stated that that another 570 victims will be buried on 11 July this year in Potocari Memorial Center. Daily reads that RS Police Director, Dragomir Andan, stated that for the past 15 days the RS MoI works in security preparations of the ceremony. FTV, RTRS – More than 50.000 people and 500 local and foreign officials are expected to attend the commemoration. The commemoration will be secured by 2000 RS MoI members as well as members of SIPA, OSA, SBS and BIH Security Ministry. The meeting on security is to be held on Tuesday next week. BHT 1 – Association of mothers of Srebrenica and Zepa enclaves that this year’s protocol request all women attending funeral to be dressed in accordance to Bosniak tradition.

Talking about the massacre in Srebrenica, among the other things, Ceric stated that it seems that those who committed the crime in Srebrenica are more preoccupied with denying of this crime than the victims of the crime with thoughts about the revenge. Ceric also said says that when those who committed the crime stop denying it, the way towards reconciliation would be opened.

NN reactions to US Congress adoption of Srebrenica resolution

 

Nezavisne Novine pg 3, announced on cover ‘Negative consequences for RS are possible’ by N. Krsman and V. Popovic – FBiH parties welcomed the Srebrenica Resolution, adopted by US HoR, while RS parties believe such an act does not reflect what was going on during war conflicts. Both F BiH and RS parties believe the Resolution would cause consequences. SDP’s Svetozar Pudaric thinks the Resolution shows consistency of American policy towards war in BiH, SDS strongly opposes to the Resolution, SNSD believes it would have negative consequences for RS. SDA’s Sadik Ahmetovic announced the party would offer a local text of the Resolution on Srebrenica to the state Parliament. BiH Minister of Civil Affairs Safet Halilovic sees the Resolution as a form of a moral satisfaction and thinks it would strengthen the lawsuit against SiCG, while BiH Justice Minister Slobodan Kovac thinks it was not developed without a reason and thinks reconciliation among peoples might be behind the Resolution. ‘Independent’ says Greek volunteers received medal from Karadzic after fall of Srebrenica

 

Dnevni Avaz pg 9 ‘Mladic demanded from Greek volunteers to erect flag of their country in Srebrenica’ not signed, Oslobodjenje pg 2 ‘Greek volunteers received medals after Srebrenca fall’ – British journal The Independent on Wednesday issued an article on the judicial inquiry Greece has launched to discover the extent of involvement of so called Greek volunteers in the Srebrenica massacre. The journal says that the Greek Volunteer Brigade fought side by side with the Bosnian Serbs and that four members of the unit received medals of honour from Radovan Karadzic within a month of Srebrenica’s fall.

Serbian, BiH Prosecutions sign agreement on cooperation

RS NGOs cancel mtg on ‘truth of suffering in war’ to avoid incidents

Nezavisne Novine pg 8 ‘A meeting was cancelled due to opening of a mosque’ by Srna – A meeting of 11 NGOs, under the motto “We will never accept the imposed one-sided truth on sufferings of only Bosniak people in Pdrinje region” will be postponed due to opening of a reconstructed mosque in Bratunac on the same day – July 2. The Deputy President of the CoordinationCenter of 11 NGOs Slavko Jovicic commented by saying it is not their goal to cause any conflicts or unrests.

DL: Strasbourg court to reach first verdict related to old savings in BiH

 

Dnevni List, pg 6 ‘First verdict for return of foreign currency savings next week’, by Tanja Dragic – Reports that the European Human Rights Court in Strasbourg will next week reach a first verdict related to the return of foreign currency savings in BiH. It is about a case of a Banja Luka-based Ruza Jelicic, who filed a first lawsuit in BiH related to the return of old savings back in 1999 when she claimed 250.000 KMs. According to President of Association of citizens for return of old foreign currency savings in BiH, Svetozar Nisic, Jelicic addressed every instance within the BiH domestic judiciary prior to seeking help with the Strasbourg court.
