ASSET FORFEITURE/MONEY LAUNDERING ADVISOR

PURPOSE AND SCOPE OF POSITION

The purpose of this position is to plan and develop a civil/criminal asset forfeiture program and financial intelligence unit in Bosnia and Herzegovina by proposing the legislation and institutions required to carry out such a program. The development of the programs is an integral part of the ongoing establishment of general supportive agencies to the newly established Court of Bosnia and Herzegovina and the Office of the Prosecutor of Bosnia and Herzegovina in terms implementing the new State Criminal Legislation.

DUTIES AND RESPONSIBILITIES

The Asset Forfeiture Advisor will inter alia conduct a thorough review of the existing legislation and institutions in Bosnia and Herzegovina responsible for the seizure and forfeiture of criminal assets. Within the scope of his/her work the advisor will assess and consider systems in other countries and also most recent developments in relevant jurisdictions. The advisor shall prepare a detailed assessment of the current procedural and budgetary situation in Bosnia and Herzegovina and he/she will be required to develop a proposed program of Asset Forfeiture Reform. The Advisor will assess the current mechanisms in BiH related to the prevention of Money Laundering and will make proposals for the establishment of a Financial Intelligence Unit. The advisor will assist the work of the CIPRU with ongoing State Institution Building projects and advise other Units in the OHR Rule of Law Pillar as required.

PROFESSIONAL REQUIREMENTS/QUALIFICATIONS

·        Law degree;

·        Prosecutor or Lawyer with at least 7 years working experience, preferably in civil/criminal Asset Forfeiture Litigation;

·        Strong interpersonal and communicative skills;

·        Excellent command of spoken and written English;

·        Solid understanding of Bosnia and Herzegovina;

·        Previous work experience in Bosnia and Herzegovina or in other Countries in the region desired.
