BiH Court issues int. arrest warrant against Jelavic

BH Radio 1 – BiH Court issues an international arrest warrant against Ante Jelavic. The move was made after the former senior BiH, FBiH and HDZ BiH official had been sentenced to 10 years in prison for office abuse on Thursday.  

PIC in session; Terzic expects CoM to accept the EU-backed agreement on police reform

 

FENA – Chairman of the BiH Council of Ministers Adnan Terzic addressed PIC Steering Board in Sarajevo today. According to his advisor for media Bojan Zec Filipovic, Terzic stated that the RSNA’s decision to accept Dragan Cavic‘s proposal on the police reform had removed the biggest obstacle for successful continuation of the BiH’s moving to Europe. Filipovic also said that Terzic had scheduled for today a special BiH CoM’s session to discuss the document adopted by the RSNA and added that Terzic expected CoM to accept the document since it reflects the three European principles. BH Radio 1 – RS President Dragan Cavic told Belgrade-based Beta news agency that RSNA acceptance of EU police reform principles had removed all reasons for any negative judgment of RS by PIC .  

HDZ Presidency/Main Board to hold session

 

RHB– HDZ Presidency and Main Board is to hold session today. According to the HDZ spokesman, Miso Relota, the Main Board will meet at 1200 hrs and the Main Board will discuss issues pertaining to necessity of carrying out constitutional changes in BiH, saying that the party will come up with its proposal of constitutional changes in two months time. Relota says the Main Board will also discuss the verdict against former HDZ President, Ante Jelavic.

SIPA is now searching for Jelavic. State Border Service has been instructed to increase control of border crossings. Relota: Jelavic should not be punished for fighting for Croats; HDZ: Verdict against Jelavic is monstrous

 

RHB– Spokesperson of HDZ Miso Ralota commented the verdict against Ante Jelavic by saying the HDZ has no intention to interfere into judiciary, but strongly criticised it. Ralota stated that this verdict proves that this whole case was politically motivated and that it sends clear message to all Croats in BiH. He added that HDZ deems that Jelavic’s fight for equality of Croat people shouldn’t have become the matter of judiciary, stressing that Jelavic’s only sin was that he was the voice of deprived Croat people in BiH. HDZ stressed that justice would demand just the contrary and that is to prosecute all those who have participated in illegal imprisonment of Jelavic. Prosecutors ass for renewal of trial of Hasan Cengic

Mackic, Nezavisne Novine pg 3, announced on cover ‘Prosecution demands for a new trial to Cengic’ by A. Durmo– Prosecutor with the BiH Court Drew Engel requested on Thursday that the June 29 decision of the First Instance Council acquitting Hasan Cengic be annulled. Cengic was charged with signing a memo in 1996 in the capacity of FBiH Deputy Defence Minister illegally authorizing “ BIO” Company to produce weapons, ammunition and explosives. Prosecutor Engel also requested a new trial before the Appeals Council.

Oslobodjenje pgs 4-5, mentioned on cover ‘Only OHR firmly trusts Cavic’, mentioned on cover – Daily carries reactions after the RSNA adoption of the police reform concept proposed by Dragan Cavic. SDA present Sulejman Tihic says that proposal poses some dilemmas and that it should be more clear, announcing SDA Presidency is yet to take an official stance. As for HDZ, there is nothing disputable in this report, said the spokesperson for the party Miso Relota. SDP leader Zlatko Lagumdzija doesn’t believe that the current coalition of the ruling political parties is capable of implementing the agreement. On the other side, daily says that OHR believe it is a significant step forward. Oslobodjenje pgs 4-5 ‘Bukejlovic doesn’t know who will implement reform’ – Daily carries Cavic who said after the session that RS has now ceased to be an obstruction to BiH’s path to Europe. SDS official, Stanko Pivasevic, said that the agreement is a result of the compromise between RS, EC and OHR. Igor Radojcic of SNSD added that this brings the story on police almost to the beginning as all issues are left to be discussed. SDA delegate in RSNA, Tarik Sadovic, welcomed the agreement calling it a slightly modified version of Adnan Terzic’s proposal with certain unclear details. RS Press feature analysts: great IC pressure; how come police reform now acceptable?

 

EuroBlic pg RS2 ‘Bukejlovic is angry’, announced on cover ‘Bukejlovic is angry at Cavic’ by Rajna Radosavljevic – Inset ‘Pressure’ – political analyst Tanja Topic thinks the pressure IC had exerted was too great and resulted in no other choice for RS authorities but to adopt the reform. She expressed regret that BiH missed its chance to launch SAA talks by two days only, having in mind that such an outcome was expected a long time ago. Political analyst Ostoja Barasin thinks RS citizens must be given an explanation on what had changed with regard to police reform “just overnight” and he says he can see no difference between this agreement and those agreements that have been offered in the past. Terzic on future activities regarding SAA talks

 

Dnevni Avaz, pg 2 ‘Dedication of all in BiH for European path has won’, by E. Sarac – In a statement for Avaz, the Chairman of BiH CoM, Adnan Terzic, says it is very good the RSNA adopted the basic European principles regarding the police reform, however he notes that the procedure is not over yet, since the BiH and FBiH parliaments have to adopt the agreement proposed by Dragan Cavic, still Terzic sees no reason why the agreement would not be adopted. Terzic says that the next step is to get the green light from the EC for the start of the SAA talks, however in the meantime his priority will be to form a negotiating team and start with implementation of all reform-oriented laws. Terzic believes that the path to opening of the SAA talks by end of 2005 is open. BHT 1 carries similar Terzic’s statement.

OHR welcomes RSNA adoption of the police reform

 

PINK by Ljubisa Davidovic – OHR welcomed the BiH House of Peoples and the RSNA decisions on adopted police reform principles and PBS law. OHR Spokesperson Ljiljana Radetic said that EC has confirmed that adopted proposal meets the conditions EC has set and which would enable the EC to recommend the launch of SAA negotiations by the end of this year. “In period of 5 years BIH will have police at the state level that will be able to cross the entity borders” said Radetic.  She added that another significant progress has been made by adopting the PBS reform. NN int with HR: BiH will get a single police structure in five years

 

Nezavisne Novine pg 5 ‘BiH will get a single police’ announced on cover ‘Police in BiH will be unified in five years’ by M. Cubro – In an interview to NN, HR Paddy Ashdown claims RS, by adopting the police reform, avoided severe sanctions that should have been decided upon at PIC session today. HR said BiH would get an efficient and single police structure, while EC will supervise the implementation of this agreement. He assessed the proposal adopted by RS NA as ‘historical’ and he added: ‘Three main obstacles – PBS Law, defense reform and police reform – were removed. However, I must say this is not over yet. We still have a job to do. CoM, F BiH and BiH parliaments must adopt this agreement’. Asked to explain why the police maps were not defined by this agreement, HR replied that the Directorate for the implementation and police experts would define the police regions. ‘This is the way it should be, because if we had defined these now it would have been a political decision’, HR added. Asked whether BiH had fulfilled all pre-requisites for launching SAA talks, HR said: ‘After the federal and state parliaments adopt the agreement on police reform and after a small law on PBS is adopted, we will be in a position to say a significant progress was made. I think it is quite possible that for BiH to launch the talks between 10th anniversary of the Dayton Agreement and end of this year’. Inset: ‘Meeting on police reform in Ashdown’s house’ – HR said the only true thing in claims on a meeting on police reform was that it was held indeed. He said the meeting took place in his house and was attended by US and British Ambassadors and Head of EC Delegation. ‘The meeting was held upon a request of RS President Dragan Cavic and SNSD President Milorad Dodik, HR added.

McElhaney: There is much left to be done [for SAA ]

Rycroft: SAA negotiations can start this year

 

Oslobodenje pg 5 ‘negotiations can start this year’ – The UK Ambassador in BiH, Matthew Rycroft, welcomed the RSNA decision on police reform. Rehn, Solana welcomed the police agreement

 

PINK, Nezavisne Novine pg 4 ‘A large step towards EU’ by A. Sekulic – EU Enlargement Commissioner Ollie Rehn and EU High Representative Javier Solana welcomed the RSNA’s adoption of the police reform proposal based on three EC principles. He said that BIH now met the conditions EC has set for the launch of SAA negotiations provided that BiH’s other Parliaments now meet the three EC principles for police reform. EC’s official Priebe: We’ll continue to monitor situation on police, PBS before recommending SAA talks

 

BHT 1 late news edition featured Reinhard Priebe, EC Director for the Western Balkans, who commented that the adoption of police agreement by the RSNA has been a very positive step and added EC is to continue monitoring developments in course of this and PBS reforms in the next several weeks. If the progress continues, EC will give its recommendation for start of negotiations on SAA talks. However, Priebe refused to give specific date of SAA negotiations start. Asked to comment the initiatives for change of BiH Constitution, Priber said that the present Constitution is complicated and inefficient. Therefore, certain changes are necessary. He emphasized that EU doesn’t plan to abolish entities, adding that all changes must be made by BiH without influence of the international community. PINK, RTRS wonder why RSNA found police reform acceptable now?

 

PINK by Dragica Tojagic –Reporter noted that RS citizens still do not understand why RS was utterly rejecting police reform principles for more than a year and than suddenly changed their opinion adding that they wonder if any of the adopted principals differ at all from the originally proposed ones. RTRS by Biljana Knezevic– Reporter stressed this sudden change of the stance, is a result of a secret meeting in Sarajevo between SNSD and SDS Leaders and IC officials. According to the reporter no one from RS negotiating team was introduced to this plan in advance, because of which Pero Bukejlovic and RS MoI Darko Matijasevic were surprised by the proposal. RTRS comments that rejection of their attempts to introduce corrections to the proposal only proved that there are disputes among those who have negotiated and the one who has supported them till recently. Author further speculates that bitterness and surprise with the outcome has brought RS Government to almost certain resignations, which however wouldn’t endanger the agreement. Analysts said that politicians failed to explain how did unacceptable become acceptable or what is happening with the Constitution, which till yesterday was the main argument for rejection

Dnevni Avaz, pg 3 ‘It turn for SDS’, by Sead Numanovic – Commenting on the adoption of the police reform by the RSNA, Numanovic says it would be appropriate to ask why BiH missed the deadline by couple of days, and more importantly will BiH find itself in a similar situation in the future. With regards to the latter, Numanovic believes it will, suggesting that the remedy for the situation is a big purge within the SDS, whose ranks are full of people with criminal records. Numanovic reckons that a logical move after the vote on police reform would be to remove Pero Bukejlovic’s government, purge the (RS) police and arrest people who stole millions of KMs from RS citizens. Oslobodjenje pg 9 ‘D day’ In Focus column by Zija Dizdarevic – The author reminds that the RSNA has overnight changed its position and accepted three EU principles on police reform. The key role in this process, according to Dizdarevic, was played by RS President Dragan Cavic and opposition leader Milorad Dodik. However they both were just executors of British-American will, concludes Dizderevic. Oslobodjenje pg 9 ‘Still no chance for Europe (with reformed nationalists, BiH citizens’ mentality)’ op-ed by Hamza Baksic – According to Baksic, although it seems Europe is closer following the RSNA acceptance of police reform principles, BiH still is not prepared for EU for several reasons including the government comprising reformed nationalists and BiH bureaucracy and citizens’ mentality, which is not meeting European standards. As an example, Baksic mentioned reconstruction of the main streets in Sarajevo , which has been lasting too long and which is being done with too many administrative obstacles/disorganization.

Dnevni List pg 5 ‘Subsequent decision on police regions’ by Z. Jukic comments on the police reform proposal by RS President Dragan Cavic and the author says that by temporary giving up one out of 3 EC principles, the EC has made a sort of concession to Cavic and SDS since it was made possible for them to avoid sanctions that would result in shutting down of ‘former Radovan Karadzic’s party’. According to a foreign diplomat, Cavic did not have strength to persuade people in SDS and RSNA to accept the police reform that would delete divisions along the entity borders. DL says that, allegedly, Cavic conveyed this stand to international diplomats who after some time agreed to pass a half-way decision on the police, that according to the DL source would result at the end in forming the police that would not be divided by the entity line.

Vecernji List, pg 6 ‘Ashdown and Cavic deceived public’, by Miroslav Vasilj – Commenting on the police reform proposal adopted by the RSNA, the author says it does not specifically say that the future police regions will be crossing the IEBL, which was, according to Vasilj, one of major EC pre-requisites. VL goes on to say Paddy Ashdown however stated on Thursday that the police regions will cross the IEBL, but was denied by Serb politicians, who called upon the (Cavic) proposal saying that it does not specifically state that. Moreover, Vasilj argues that the five-year period for the implementation of the agreement will buy additional time for the Serb side, arguing that agreement between the RS and OHR saves mandates of RS President Dragan Cavic and HR Ashdown.

Vecernji List, pg 23 ‘Compromise for RS’, by Dejan Jazvic – Commenting on the police reform proposal adopted by the RSNA, Jazvic argues that the RS authorities, by adopting it, escaped one of scenarios according to which the IC was ready to abolish the RS. Still, the author says the agreement does not provide some important answers, namely what the future police regions will look like and what the competences of the entities are. Jazvic concludes that the agreement is obviously a compromise, which is a minimum of what the EC requested to approve the start of the SAA talks with BiH.

Feral op-ed on police reform: Europe not willing to exert pressure for stabile solutions

 

Feral pgs 32 and 33 ‘Hostages of Serb batons’ by I. Lovrenovic – Commenting police reform implementation and general BiH political situation, author implies that SDS, HDZ and SDA have developed perfect coordination among themselves protecting each other. Lovrenovic also harshly comments on the role of Europe in BiH and he says that Europe does not want to exert any extra effort in order to find thorough and stabile solution for the status of BiH and that Europe does not find anything paradoxical and cynical in their recognition that the RS leadership is responsible for possible isolation of whole BiH. Lovrenovic says that European diplomats are very well aware that such anti-European behaviour of the RS is simply legal and it logically comes out from the RS ‘political nature’.

Nezavisne Novine pg 2 ‘Law on amnesty was adopted’ by N. N., Dnevni List pg 4 ‘Initiative for change of Constitution launched’ by NINA  – RS NA also adopted the Law on Amnesty, which is harmonized with the relevant legal acts on the other levels in BiH. The Law envisages exceptions that refer to gross criminal acts such as murder, rape, abuse of office, and others. RS NA also adopted the Law amending the Law on implementation of criminal and offence sanctions. RSNA rejects transfer of banking supervision authority to Central Bank

 

RTRS By Nada Arlov – RS Government discussed the information on BiH Central Bank’s initiative for transfer of banking supervision authority to Central Bank. RS Government decided against this initiative, since, as in accordance with the Constitution, the banking system in under authority of RS. RS Government has sent a letter to PDHR Lawrence Butler and confirmed it on Thursday’s session, stressing that this demand is unconstitutional and instead of the abolishment of the RS Banking Agency it suggested expansion of the authorities to surveillance of other financial institutions in RS. “Banking sector is singular, but we can’t merge institutions over night and hope that it will certainly contribute to better work,” said RS Minister of Finances Svetlana Cenic. However, experts, such as Borislav Bijelic, claim that centralisation of surveillance over Banks is indisputable and that without it there can be no association with the EU. OHR Spokesperson Ljiljana Radetic said: “This is not a political issue, it is about finding most functional banking system that would better protect interests of users”. Cenic said that she doesn’t believe in the statement by the PDHR Larry Butler that centralised system would contribute to decrease of interest rates. “That simple merge of the agencies will bring decrease of interest rate. I am economist and I would like if some one with more expertise then me would explain how,” stated Cenic. While Ministry of Finances see the solution in better coordination of existing agencies with the Central Bank, experts are wondering why this much struggle for Banks which were sold out a while ago. Glibusic– Political Directors of Peace Implementation Council’s Steering Board are meeting in Sarajevo on Thursday and Friday to discuss BiH progress in reform processes, especially after passing of defence and police reform and of Law on PBS. During the meeting, Directors will discuss revitalization of BiH economy, implementation of arbitrage decision on Brcko, success of Srebrenica Working Group and issues in education reform. Nezavisne Novine pg 4 ‘Patijn instead of Ashdown’ by VOA – the article speculates that a possible successor of HR Ashdown might be Dutch Michel Patijn. Dnevni Avaz pg 2 ‘Election of new HR postponed’ – DA learns that PIC will not discuss the new HR as Germany has not yet submitted the name of its candidate. It also says that Patijn, Laura Marachian from Italy, Aleksandar Vondra from Czech Republic have been nominate to the position to date.  

Avaz: Martens wants annulment of election of Covic

 

Dnevni Avaz, pg 3 ‘Martens wants annulment of election of Covic’, mentioned on front ‘Dragan Covic illegally at helm of HDZ’, by S. Numanovic – Avaz claims to be in possession of a letter that the President of European People’s Party (EPP), Wilfried Martens, sent to the Presidency of HDZ BiH, in which he notes that the election of Dragan Covic for the HDZ President was irregular, demanding from the HDZ Presidency to organize new elections that would be free of irregularities. Inset ‘Covic: There is no repetition of Congress’ carries Covic as saying that he does not think about repetition of the HDZ Congress, arguing that pre-requisites are not met since the Congress is held every two years. Regarding EPP’s position, Covic says it is an attempt to destabilize the HDZ and hush up the Croats’ efforts to initiate constitutional reforms. Other inset ‘Surplus of votes in ballot boxes’ carries a member of HDZ Presidency, Vinko Zoric, who says the elections should be repeated, claiming that 541 people were eligible for voting for the HDZ President, however there were 544 votes in the ballot boxes. Batarello also covered the EPP letter to HDZ and DL says that EPP expects that HDZ would reply to this letter by November 7, 2005 when the meting of the EPP political department should take place. Covic on verdict agst Jelavic, const. changes, police, Martens’ letter

 

Vecernji List pg 5 ‘Verdict against Jelavic is bed message to Croats’, mentioned on cover ‘3 Federal units solution for BiH’ by Z. Kresic carries an interview with HDZ President Dragan Covic who condemns verdict pronounced against Ante Jelavic and says that the Jelavic’s justified struggle for equal position of the Croats people could not have been a subject to the trial. Talking about the constitutional changes Covic says that he is afraid that a compromise between the Serb and Bosniak people might damage Croats permanently and he added: ‘This would mean elimination of Cantons and survival of entities and this is absolutely unacceptable for us. For this reason we want to say that the middle authority level cannot be anything less then 3 Federal units.’ Asked to comment on the agreement on the police reform, Covic says that they are satisfied if this agreement is good for the EU and if it opens the way for the European integration. Dnevni List pg 5 ‘Finally discussion on Bozo Ljubic’s appeal’ not signed announces the HDZ Presidency session that is to take place on Friday (today) and DL says that they will discuss constitutional changes. After this session the session of the HDZ Central Board would take place in order to discuss Bozo Ljubic’s appeal on regularity of the elections for the HDZ President and adoption of the Law on public RTV system as well as steps that representatives would take in order to protect interests of the Croat people. 

BN TV int with Paravac: big const. changes could destabilize BiH

 

TV BN ‘Puls’ current affairs – Serb member of BiH Presidency, Borislav Paravac, stated last night (Thursday) in an interview to Bijeljina based TV BN that big constitutional changes could de-stabilize BiH and that the current constitutional organization must be observed. On situation regarding the BiH Council of Ministers, Paravac says since the SDS withheld its support to the BiH CoM, other Serb parties did the same, arguing that the CoM Chairman, Adnan Terzic,is now acting like maverick. Furthermore, he says he has nothing against establishment of the third entity, adding it is a matter for the Bosniaks and Croats in the FBIH.

SDHR: Pecelj must remove Radomir Lukic by October 10’; Students defend Lukic

 

Dnevni Avaz pg 12 ‘Pecelj must remove Radomir Lukic by October 10’, Nezavisne Novine pg 2 ‘Possible measures against Minister Pecelj’ by G. Maunaga– SDHR Martin Ney sent a letter to RS Prime Minister Pero Bukejlovic in which he warned him that OHR will be forced to take serious measures against most responsible for breach of the High Representative’s decision on replacement of the Dean of faculty of Law in Eastern Sarajevo Radomir Lukic, if it is not carried out by October 10th. In his latter, SDHR Ney has marked RS Education Minister Milovan Pecelj as most responsible; stressing that Pecelj has enabled Lukic to perform his duties on the Faculty. Glas Srpske pg 3 ‘Students defend professor’ not signed – Students and professors of ES Faculty of Laws think the decision on removal of Lukic was null and void and they sent a letter to Pecelj noting that the professor’s position was protected by the University’s autonomy and was also guaranteed by the Bologna Declaration.

Oslobodjenje: ‘Withdrawal of lawsuit against SCG is price for entering EU

Oslobodjenje, pg 7, mentioned on front ‘Withdrawal of lawsuit against SCG is price for entering EU’, by Az. Kalamujic – The article reminds that the UK Foreign Secretary, Jack Straw, made a proposal in May 2005 that BiH and Croatia drop genocide charges against SCG, and the author speculates that this issue could hinder BiH’s progress en route to the EU, believing that Straw is directly involved in that and that SCG will use its position and traditional allies to have the charges dropped. Director of BiH Directorate for European Integration, Osman Topcagic, says the lawsuit against SCG has never been mentioned in talks with representatives of the EC, however since the EC requires from EU members/candidates to solve their disputes, Topcagic reckons it opens door to various interpretation of the requirement.
