International arrest warrant issued for Ante Jelavic

 

 

 

 

 

 

BHT 1 by Boris Grubesic – BiH Interpol has issued an international arrest warrant for Ante Jelavic, former BiH Presidency member who is sentenced by the Court of BiH to ten years in prison for multimillion fraud and office abuse. The international arrest warrant for Jelavic has been forwarded to 184 Interpol member countries; they all received the request for Jelavic’s extradition, which includes his photo and the brief description of his crimes. But that does not mean that Jelavic would be automatically extradited if he is arrested in one of those countries: in fact, the Ministry of Justice in country where Jelavic is arrested would have to decide whether he will be extradited or not, stated Interpol BiH Deputy Head Adi Biser. State Information and Protection Agency (SIPA) and State Border Service are searching for Jelavic, but until now his whereabouts remain unknown, confirmed SIPA Spokesperson Admir Katica. Since it is very possible that Jelavic could be hidding somewhere in Croatia, BiH security services contacted their counterparts in Croatia asking for help; the problem, according to BHT reporter, lies in the fact that Jelavic has Croatian citizenship as well, and Croatian constitution does not allow the extradition of its citizens.

Mackic – DL speculates that if Ante Jelavic is in Croatia, than Croatian authorities will most probably seek transfer of the proceeding before its court, i.e. would seek from BiH judiciary to transfer all documents and than decide whether a proceeding should be renewed before its local judiciary. DL’s source from Croatian judiciary says that from legal point of view, Jelavic is now safest exactly in Croatia. Dnevni Avaz pg 3 inset – BiH Court is to decide what to do with Jelavic’s bail of half million KM, i.e. whether to keep the total sum which should done be forwarded to the state budget or not. Oslobodjenje pg 4 inset ‘Halt of the process’ – Daily says that unless Jelavic is arrested by 20 October, there will be changes in the proceeding still being led against him, Miroslav Prce and Dragan Curic before the BiH Court in case of Croat Self-Rule. According to daily, the current law doesn’t stipulate trial in absence, thus if he is still in run, the part of the proceeding against him will most probably be halted. FTV – At the session of HDZ Main Board and Presidency, party’s members HDZ condemned the verdict in the case of former HDZ leader Ante Jelavic, as well as the way BiH Court was conducting this case. Hayat by Alem Karamesic – Reporter comments that HDZ continues to stand behind Jelavic, considering that he didn’t escape, but that his disappearance is a result of Court’s injustice, stressing that sentence to Jelavic is another reason why Croats have lost faith into the Court. RHB– HDZ Board of Central Bosnia also strongly criticised verdict against Jelavic, deeming it as another pressure exerted against Croats in BIH. Nezavisne novine pg 2, mentioned on cover, ‘Arrest warrant for Jelavic issued’ by A. Durmo – Member of HDZ Presidency, Davor Cordas, told media in Mostar that Ante Jelavic’s failure to appear before the Court cannot be called a runaway. “Every man feels has difficult time to face injustice, and Jelavic feels this deep inside. Every reaction is justified and it would be wrong for any of us to comment it,” says Cordas.

Glas Srpske supplement ‘Glas Plus’ pg 2 ‘One cannot live out of illusion’ by Nedeljko Zelenovic – In an interview to GS, the FBiH Niko Lozancic comments to the proceedings against Ante Jelavic before the BiH Court: “Proceeding against Mr Ante Jelavic is politically orchestrated… Verdict proves my thesis. The fact is that the highest political organs in BiH employ more foreigners than BiH citizens. That says enough about our independence.” Asked whether he implies the international community created the judiciary to serve it, Lozancic responded: “You said that. I have nothing against this stance of yours.”

Oslobodjenje pg 9 ‘An image of ‘national guardian’’ op-ed by Mirko Sagolj – Commenting the verdict against Ante Jelavic, author says nobody can assure him that Jelavic has ‘clean hands’ when it comes to finances adding that his decision to run away only further shows the character of all those ‘national guardians’ who “fight for the rights of their people”. Most important, says the author, Jelavic has been fully supported by his party, HDZ, as it was the case with every other official of one of the ruling parties who stood trial. “The essence of this problem is the fact that the crime, even the one of the biggest size, is being masked… as in the interest of ‘my deprived people’,” concludes the author.

Nezavine novine pg 7 ‘Runaway’ op-ed by Sasa Cavrag – Author also notes Jelavic should have stayed and face the verdict to show is a man of the ideas he proclaims. It also wonders why the HNK police, who was supposed to be in contact with Jelavic every morning and evening, did not carry out preventive measures which would avoid this situation. “The respond is either incompetence or something else,” says author noting Jelavic failed to contact police in the morning, but they have not acted until BiH Court asked them to do so.

BHT 1 by Seid Masnica – BHT 1 comments that after the President of European People’s Party (EPP), Wilfried Martens, sent a letter to the Presidency of HDZ BiH, in which he notes that the election of HDZ President should be repeated due to irregularities new tensions were raised inside this party. While some members of HDZ believe that Covic was elected in a fair and transparent way, others claim that this letter came just in the right moment. Friday’s sessions of the HDZ Main Board and Presidency was supposed to be focused at the changes to the BiH Constitution, instead members mainly discussed the EPP’s letter. “We believe that they are not well informed about the circumstances in which HDZ election assembly took place. We will send them a correct and true information”, said member of the HDZ Presidency Niko Lozancic. HDZ President Dragan Covic avoided answering journalist’s question about the irregularities during the elections for HDZ President. Instead, says reporter, he started praising his party: “We are European, democratically organized party, and we were elected in a legitimate way”, stated Covic. On the other hand, some HDZ members believe that the EPP accusations and requests are justified, because the number of ballots counted after the elections for HDZ President was bigger than a number of voters. Bozo Ljubic, the candidate who lost the elections, held a meeting with his supporters inside HDZ. They request new elections. According to the HDZ statute, that would be possible if certain number of HDZ members asks for it. FTV – Ljubic stated that current HDZ Presidency should resign; any other solution would be wrong and would only lead to this party’s isolation, stated Ljubic. HDZ answers to Martens: elections were legal; some HDZ officials do not agree

DL says some HDZ officials were angry at the stance of the HDZ Presidency, naming member of party’s presidency Vinko Zoric, Martin Raguz, Josip Merdzo and a number of others, deeming such ignorance of EPP’s concerns to be utterly irresponsible. HDZ concludes that after the sessions, chances for the new HDZ President are minimal. FTV – FTV comments that the letter was not to be signed by all HDZ Presidency members. Prior to confirmation being sent, FTV names Vinko Zoric as one of those: “If there really was 541 voters and 544 ballots in the ballot box… well, if I was the one to be elected as the HDZ President in such way, i would immediately cancel the negotiations and convene a new one.Hayat – also carries Zoric’s statement. RHB– The HDZ said in a letter to EPP it is looking forward to an early meeting with the EPP leadership to exchange views on all issues of cooperation, activities and mutual relations. Raguz said of the EPP’s letter that it is not to be ignored.

HDZ says BiH must have new constitution by elections in 2006

 

Dnevni Avaz pg 9 ‘New constitution until 2006’, Nezavisne novine pg 2 ‘BiH must get new constitution’, Glas Srpske pg 2 ‘Constitution ready for retirement’ – HDZ Main Board concluded at a session held in Mostar on Friday that BiH must have a new constitution, as the current organization of the state is not viable. The party statement says that the new constitution should be adopted through parliamentary procedure by the time of the next municipal elections, at the latest. “The new reorganization of BiH should have a pronounced concept of decentralized administration, equal development secured for all parts of BiH , as well as ensuring a rational administrative structure which would satisfy the national interests of all three constituent peoples,” the statement says. RTRS by Bozidar Stajcic – HDZ Chair Dragan Covic stressed that BIH should consist of 3 federal units, and added that HDZ would establish contact with other parties in order to discuss the constitutional changes. He added that Croats must seek their equality in BIH if RS remains a reality. FTV – HDZ also announced the meetings with other Croat parties to harmonize their positions regarding constitutional changes; those meetings are scheduled for Monday. Hayat – also carried.

Glas Srpske supplement ‘Glas Plus’ pg 2 ‘One cannot live out of illusion’ by Nedeljko Zelenovic – In an interview to GS, the FBiH Niko Lozancic strongly criticises the current BiH Constitution claiming that it brings no good to any of the peoples. Lozancic adds all agree about it, but there are difference in opinions of the form of the constitutional changes needed. As an example of the ill constitutional provisions, Lozancic gives examples of adoption of the PBS law in the BiH House of Peoples despite the opposition of all Croat delegates as well as the powers of the High Representative.

HDZ appoints chairs/deputies of its boards; says Colak should lead body in charge of police reform 

RHB– HDZ Presidency and Main Board held sessions in Mostar on Friday. HDZ spokesman Miso Relota stated that the Presidency appointed HDZ Boards Chairs’ and their Deputies. Niko Lozancic was appointed as Chair of Board for Constitution and legislative with Borjana Kristo as his deputy. Chair of Board for internal policy and security is Rade Bosnjak and Barisa Colak is his deputy. Dragan Vrankic is the new Chair of Board for economy and finance whilst his deputy is Ljerka Maric. Chair of public relations and information Board is Mladen Bevanda and his deputy is Zeljko Raguz. Chair of Board for health, social policy, refugees and Displaced persons is Davor Cordas whilst his deputy is Ivica Marinovic. Chair of Board for foreign affairs and emigration is Ivo Miro Jovic and Antun Ril is appointed as his deputy. Relota also stated that HDZ decided upon its election strategy in 2006. When it comes to police reform HDZ accepts 3 EC principles and will insist that BIH Security Minister Barisa Colak is leading the body that will implement that process.

Cubro – The Political Directors of the Peace Implementation Council Steering Board who met in Sarajevo on 6 and 7 October reviewed the progress that the BiH authorities have made in implementing the reforms necessary to join Partnership for Peace and to begin Stabilization and Association Agreement negotiations with the EU. In a communiqué issued following the meeting, PIC Steering Board welcomed the RSNA’s adoption of an agreement on police reform, endorsement of the Public Broadcasting System law and recent adoption of the BiH Defence Reform legislation. Regarding the VAT introduction, Steering Board expressed their full support for the Indirect Taxation Authority and welcomed the fact that technical preparations were proceeding according to plan. Political Directors also expressed regret that all ICTY indictees, particularly Radovan Karadzic and Ratko Mladic, have not yet been transferred to the ICTY, noting that the only outstanding requirement for BiH to accede to PfP is full cooperation with the ICTY. The Political Directors strongly and unconditionally opposed segregation and discrimination in schools in BiH, calling on all responsible authorities to ensure that all disputed decisions on school divisions are reversed.  PIC also welcomed Srebrenica report and progress made towards unifying the Mostar City institutions. On Brcko, the Steering Board urges the CoM to implement the proposal of the Brcko District authorities to establish a District Office within the state-level executive as soon as possible. 

Terzic on PIC Steering Board session, SAA; Ivanic: current CoM cannot lead SAA negotiations

 

BHT 1 by Damir Simic – BiH Council of Ministers Chairman Adnan Terzic had convened an extraordinary session of the CoM to discuss the police reform agreement adopted by the RSNA, stressing that as soon FBiH Government and FBiH Parliament adopt it BiH will have all 16 conditions set by the Feasibility Study fulfilled. “Few days after that EC should recommend that EU Council of Ministers to allow BiH to start the SAA negotiations”, added Terzic. Despite the recent developments, BiH Minister of Internal Affairs Mladen Ivanic does not believe that this CoM will be able to successfully negotiate on SAA. Terzic responds saying Ivanic has no influence on the negotiating process, because Terzic’s cabinet and the Office for European Integrations are responsible for this issue. In its communiqué, the PIC Steering Board urged CoM to establish a Brcko District Office within the state-level executive as soon as possible. “(Brcko Mayor Mirsad) Djapo and I have already made an agreement, along with the representatives of the US Embassy, on opening the Brcko District Office at BiH CoM. Unfortunately, ministers from RS were not satisfied with this decision”, said CoM Terzic.

Ashdown explains that five years deadline for implementation was not defied as such without a reason: “We had on mind the financial capability of the country. In the current situation, it could not deal with the shorter police reform.” Talking to DA after the PIC Steering Board session, Ashdown said that the decision on police was welcomed, but now we are to look into the implementation. PIC underlined 3 EC principles, and it is clear, says Ashdown, “that the inter-entity border line will be cross where needed, in say three cases. EU, supported by US but also other PIC countries, will now monitor police reform.” On the SAA talks, Ashdown estimates that if everything goes right they could be commenced by the mid-December. Asked which are guarantees that in a year situation alike today [referring to long police reform negotiations] would not be repeated, Ashdown answered: “EC will supervise the process of reform implementation. If it lack, than the integration process is to be stooped… EC, as my successor, will act as police… Sanctions for those responsible [for possible halts] will face draconian sanctions… We leave Dayton and enter Brussels. CoM adopts agreement on police reform

 

RHB, PINK, FTV, RTRS, Dnevni Avaz pg 2 ‘Agreement on police adopted’, Nezavisne novine pg 3 ‘CoM adopted agreement’- The BiH Council of Ministers held an extraordinary session on Friday and accepted the agreement on police restructuring in BiH, which was adopted by the RS National Assembly on Wednesday. The Agreement will be forwarded to the BiH Parliamentary Assembly and the FBiH Government for adoption, was announced by the Council of Ministers. Dnevni Avaz pg 2 ‘BiH parliament will not adopt documents by entities assemblies’ – Speaker of BiH HoR, Nikola Spiric, denied Adnan Terzic’s statements that the BiH Parliament has to vote on the police agreement. He added that the state parliament should not vote on the documents passed by the entities assemblies. Dnevni Avaz pg 2 inset ‘FBiH is to act most urgently’ – Muhamed Ibrahimovic, FBIH HoR speaker, confirms that this House on Friday met with the OHR for consultations on the police reform agreement adopted by the RSNA. He added that the FBiH Government is to prepare the text of this agreement, expecting the HoR to discuss it already in Tuesday and expressing hope HoP is to follow immediately.

SDA: delegates in FBiH parliament will address some unclear things; Tihic: We will not be obstacle

 

Dnevni Avaz pg 2 ‘Tihic: we will not be obstacle’ by A.M. – At the session held on Friday, the SDA Collegium discussed the agreement on police reform concluding there are certain unclear things in the proposal which are to be addressed by the party’s representatives in the FBiH parliament. SDA leader, Sulejman Tihic, said that main objections of the party are given deadlines and their duration, principle that the BiH and entities’ constitutions must be respected and possibility for different interpretations. However, he adds that the SDA will certainly support the agreement. “We will not be an obstacle. If the agreement is good enough for US and EU, than it is good for us too,” concluded Tihic.

Nezavisne novine pg 7 ‘Dying of people and police’ op-ed by Ugo Vlaisavljevic –  Commenting the decision of the RSNA to adopt the agreement on police reform and consequent reactions welcoming it, the author notes that this news was not news really as the agreement was the least the RS authorities could do. He stressed the authorities accepted something that had to be accepted, nothing more, also referring to fives years deadline for implementation they agreed to [implying it is too long].

Oslobodjenje “Pogled” supplement pg 28 ‘BiH still has chances to overrun its neighbours’ by Senka Kurtovic – In an interview to daily, the UK Ambassador to BiH Matthew Rycroft welcomed the RSNA’s adoption of the police reform agreement, stating that BiH can now start SAA talks under condition that the FBiH authorities also pass this concept. Asked about the important of PBS reform for the SAA talks, Rycroft stated that this law is extremely important, adding this law is not an obstacle to SAA, but stressing the important of continued cooperation with the ICTY. On the issue of constitutional changes, Rycroft commented: “We will not propose or impose any constitutional changes, but if the leaders of this country agree that [those] can strengthen the country, we will support it.” Commenting the current structure of BiH, Ambassador noted that this is an issue for citizens/politicians, and added: “In my personal opinion, the number of those employed in the state bodies is ridiculously high. Some kind of unification, even decrease, is necessary… Besides, EU works with states, not entities or cantons.” Rycroft also said that if BiH opens SAA talks, early elections are unnecessary thought. 

US official Di Carlo: US wants to have BiH admitted to EU

 

Nezavisne novine pg 4, mentioned on cover, ‘US wants to have BiH admitted to EU’, Dnevni Avaz pg 9 ‘There is no admittance to NATO and EU until Karadzic, Mladic and Gotovina are at large’ by S. Numanovic, pg 9 ‘US toppriority is for BiH to become part of EU’ – Assistant to Deputy US State Secretary, Rosemary Di Carlo talked to DA and NN journalists on Friday welcoming the RSNA decision regarding the police reform and urging parliaments to adopt it. Talking about priorities of the US Administration in BiH, Di Carlo notes full implementation of the defence reform, economic and democratic reforms fulfilled, and especially in the fields of rule or law and fight against crime. She concluded that the top priority of US administration is to see BiH becoming EU memebr state.

RS Elektroprivreda drops lawsuit against Ceko

 

BHT 1 by Zoran Sarenac – According to RS Minister of Economy, Energy and Development Miladin Gligoric’s information, Elektroprivreda RS has withdrawn the lawsuit against Chief RS Auditor Bosko Ceko. The lawsuit was brought after Ceko’s audit report on Elektroprivreda dealings. But, instead of Ceko, the management of Elektroprivreda could have been dismissed if it did not withdraw the lawsuit; at least that was the warning issued by the RS Government. “We expect that Elektroprivreda will undertake appropriate measures against persons responsible for omissions stated in auditor’s report”, said Head of the RS Government Public Relations Bureau Cvijeta Kovacevic on Friday. Ceko himself believes that the lawsuit is nothing more than an attempt to discredit him and his institution. RTRS by Momcilo Ostojic – The decision on lawsuit withdrawal occurred after the warning made by RS Government that it will dismiss the management of RS Elektroprivreda unless it withdraws the lawsuit. Gligoric stated that it makes no sense for a state company to sue a state institution.

RS Government tries to implement decision on Lukic within deadline

 

Glas Srpske pg 2 ‘Lukic without salary’, Oslobodjenje pg 4 ‘Case of Radomir Lukic to be solved by 10 October’ by Fena – The RS Government and the Ministry of Education are trying to resolve the situation concerning Professor Radomir Lukic ever since this issue was opened by the OHR, the Chief of the RS Government’s Public Relations Bureau, Cvijeta Kovacevic, said on Friday. Kovacevic told a press conference that the Government is attempting to resolve the situation with full respect to the set deadline, and that they are “trying to finally find a solution that will not jeopardize the integrity of Prof. Lukic, autonomy of the University and implementation of the HR’s Decision, which is very difficult to ensure”. She added that RS Government has asked the Eastern Sarajevo Law Faculty to carry out HR’s decision and remove Lukic; meanwhile it has suspended payout of all finances from state budget to Lukic.

Glas Srpske cover splash story ‘There was no genocide’ by Tanjug SCG legal representative Radoslav Stojanovic talks about BiH lawsuit against SCG saying it contains a number of exaggerations  and incorrect information. Stating the genocide did not occur, he adds that the lawsuit is nothing but the war propaganda and that it just burdens the relationship between two countries. “If however the Serbs is accused, than nothing good is to happen for RS,”  says Stojanovic noting that RS would also be accused.
