Comment on FBiH HoR amendments, which state that decertified police officers may be reinstated where there is a Court Decision confirming that there were no grounds for desertification
The BiH Presidency on 15 September 2004 called on all competent authorities to adopt appropriate legislation which would enforce UN decisions denying certification to former police officers. BiH has an obligation, restated by the UNSC Presidential Statement in June 2004, to uphold the UN’s decisions. The proposed amendment, in recognising the ability of Courts to overturn UN decisions, is therefore incompatible with the BiH Presidency’s requirement, UN resolutions and BiH’s obligations under international Law and agreements.
If this amendment now passes into Law it will call into question the willingness of the FBiH authorities to implement BiH’s international obligations and undermine BiH’s efforts for further Euro-Atlantic integration.
