Decision by the HR Repealing the Decision Blocking All
Bank Accounts Held by and/or in the Name of the SDS and Requiring the SDS to
Establish one Bank Account of 30 July 2004 and the Decision Extending the
Effects of the HR’s Decision Blocking All Bank Accounts Held by and/or in the
Name of the SDS and Requiring the SDS to Establish one Bank Account of 22
September 2005
On 30 July 2004 the High Representative, in the exercise of his authority
under Article V of Annex 10 of the General Framework Agreement for Peace,
ordered blocking each and every account held by and/or in the name of the SDS,
including local and municipal SDS organizations and establishment of one bank
account in a commercial bank duly licenced in Bosnia and Herzegovina to be used
for any financial transaction in excess of 150 KM, in order to prevent the SDS
funds to be used to assist persons indicted under Article 19 of the Statute of
the International Criminal Tribunal for former Yugoslavia.
After repeated violations of the 30 July 2004 Decision, on 22 September 2005
the High Representative issued the Decision Extending the Effects of the High
Representative Decision Blocking All Bank Accounts Held by and/or in the Name of
the SDS and Requiring the SDS to Establish one Bank Account, pursuant to which
the SDS single account was to be used for all financial transactions.
Considering that the remaining indictee in relation to war crimes perpetrated
in Bosnia and Herzegovina, Ratko Mladić was arrested on 26 May 2011 and
transferred to the Hague/ICTY on 31 May 2011, the reasons for application of the
above listed decisions no longer exist. The High Representative has therefore
decided to repeal the Decision Blocking All Bank Accounts Held by and/or in
the Name of the SDS and Requiring the SDS to Establish one Bank Account of 30
July 2004 and the Decision Extending the Effects of the High
Representative’s Decision Blocking All Bank Accounts Held by and/or in the Name
of the SDS and Requiring the SDS to Establish one Bank Account of 22 September
2005.
This Decision has immediate effect and will not require any further
procedural steps.
This Decision shall be published in the Official Gazette of Bosnia and
Herzegovina and the Official Gazette of Republika Srpska.
