Decision by the BiH Constitutional Court

The Office of the High Representative has learnt that the Constitutional Court of BiH has announced a decision interpreting the BiH Constitution in relation to the Constitutions of the Entities.

This decision has not yet been issued in writing.

The Constitution of BiH states that “the Constitutional Court shall have exclusive jurisdiction to decide whether any provision of an Entity’s constitution or law is consistent with this Constitution” (Art. VI, Paragraph 3a) and that “decisions of the Constitutional Court shall be final and binding” (Art. VI, Paragraph 4).

Decisions of the Constitutional Court are therefore final and have to be implemented by all institutions of the country.
