Agreement on Mostar

  1. The E.U. Presidency in consultation with the Administrator of Mostar has provided the Parties with a comprehensive solution for the integration of Mostar as a unified city, including the delimitation of the Central Zone. The Parties have adopted this comprehensive solution (see the map in annex, which will come into effect with the measures at a) and b) below at 12:00 hrs at 20 February) and the following steps of implementation:
    1. The deployment of the Unified Police Force of Mostar under the authority of the Administrator will start on 20 of February at 12.00 hours commencing by joint patrols. In order to strengthen and accelerate the unification process, the Administrator will have at his disposal 100 additional police officers seconded from Croatia as well as 100 additional police officers from Bosnia Herzegovina (sent from outside Mostar)
    2. On 20 February at 12.00 hours complete and unlimited freedom of movement for all will come into effect in the City of Mostar.
    3. Refugees and displaced persons will be allowed to return to all areas of Mostar and, with respect to the Central Zone, their return will be organised in a phased arrangement in accordance with the following criteria:
      • A significant area of the Central Zone will be, with the financial support of the European Union, reserved for public use and for the encouragement of local cultural activities.
      • In implementing the arrangements for the return of refugees, only a limited part of the Central Zone will be available for residential accommodation.
      • Only those with the legal right to residence at the time of the 1991 census will be entitled to return.
      • The process will start with empty flats and houses one month after the decree of the interim statute has come into force.
      • Other owners will be entitled to return only when there is adequate alternative housing for refugees now living within in the Central Zone.
  2. The two parties have asked to the E.U. to prolong for six months the mandate of the European Administration.
  3. The E.U. will monitor compliance with this agreement and the Presidency is prepared to recommend a review of the relationship between the E.U. and any non compliant party.
